Darbā pētīti par tradicionālajiem pieņemtie valstiskuma kritēriji, kas apkopoti Montevideo konvencijā. Teorijā pieņemts, ka veidojumam jābūt valdībai, kas spēj stāties attiecībās ar citām valstīm un kontrolē teritoriju, kurā uzturas tās iedzīvotāji. Autore secina, ka tas ne vienmēr atbilst praksei un par valsti var kļūt arī veidojums, kura valdība nekontrolē visu tā teritoriju. Starptautiskā sabiedrība nosaka veidojuma atbilstību šiem kritērijiem un te redzama atzīšanas nozīme. Par atzīšanas ietekmi valsts rašanās procesā pastāv divas pretējas teorijas – konstitutīvā un deklaratīvā, par atbilstošāko praksei tiek uzskatīta pēdējā, tomēr neviena pilnībā neaptver atzīšanas nozīmi. No prakses secināms, ka atbilstība kritērijiem un atzīšana mijiedarbojas – jo vairāk valstu atzīst veidojumu par valsti, jo mazāk uzmanības tiek pievērsts tā neatbilstībai valstiskuma kritērijiem, un otrādi. Autore ierosina paplašināt Starptautiskās tiesas jurisdikciju un noteikt tās pienākumu analizēt katra jauna veidojuma prasību kļūt par valsti no tiesiskā aspekta, sniedzot rekomendāciju šai jautājumā, pārējo apstākļu vērtēšanu atstājot valstu ziņā. The topic of this paper is to research traditional criterion of statehood, which are summarized in Montevideo convention. It is accepted in theory, that entity must have a government with capacity to enter into relations with other States and control over its territory in which are placed its population. Author of this work comes to conclusion, that theory not always agree with practice and it is possible for entity to become a state even without controlling all of its territory. It is international community, which determines its subjects and this is where recognition gets so important. There are two main theories about recognitions role in creation of states – the consitutive theory and the declaratory theory, from which the latter is considered to be more consistent with practice, althougt none of them demonstrate the full nature of recongition. It can be concluded form pracice, that conformity with criterion and recognition both correlate – the wider is recognition, the less attention is paid to conformity with criterions of statehood and vice versa. Author suggests to widen the jurisdiction of the Court of Justice, so it would analize entity’s claim of statehood from legal point of view, leaving evaluating of other aspects to the states.
