Darba mērķis ir noskaidrot, kā starp administratīvajām un civiltiesām risināmi sarežģīti pakļautības jautājumi un vai tām ir iespējams atkāpties no procesuālā regulējuma, pamatojot to ar tiesībām uz taisnīgu tiesu un tiesību tālākveidošanu.
Darbs ir balstīts uz Augstākās tiesas un Satversmes tiesas prakses izpēti un tiesību doktrīnām.
Pirmajā nodaļā autore aplūko procesuālo regulējumu pakļautības civiltiesām un administratīvajām tiesām noteikšanai, kā arī risinājumu sarežģītu jautājumu gadījumos.
Otrajā nodaļā autore pievēršas sevišķi sarežģītu pakļautības jautājumu definēšanai un to risinājumiem Latvijas tiesu praksē.
Pēdējā nodaļā autore pēta, vai aplūkotie Latvijas tiesu motīvi, risinot pakļautību, ir attaisnojami ar tiesībām uz taisnīgu tiesu un tiesību tālākveidošanu.
Galvenie darba laikā izdarītie secinājumi ir apkopoti kopsavilkumā The objective of this paper is to elaborate on how to resolve competence issue between the administrative and civil courts. Whether the court may relinquish the procedural provisions and instead establish its competence by invoking the right to fair trial or several legal methods.
The paper is based on the research of the case-law by the Supreme Court and the Constitutional Court, as well as - the legal doctrine.
In the 1st part: the author draws the attention to procedural provisions regulating the division of the competence between the both courts.
In the 2nd part: she focuses on particularly complicated competence issues, as well as the solutions of them.
In the final part: the author comes up with an answer whether the reasoning in the case-law of the Latvian courts is compatible with the right to fair trial and the several legal methods.
