Bakalaura darba galvenais mērķis ir nošķirt slepkavību bez pastiprinošiem vai mīkstinošiem apstākļiem no tīša smaga miesa bojājuma nodarīšanu, kas vainīgā neuzmanības dēļ bijis par iemeslu cietušā nāvei. Darbs ir strukturēts tā, lai vispusīgi analizētu un rastu priekšlikumus Krimināllikuma 116.panta un 125.panta trešās daļas nošķiršanai un piemērošanai praksē.
Darba pirmajā nodaļā, izmantojot krimināllikumus sākot no 1845.gada līdz mūsdienām, ir apskatīta slepkavības un smagu miesas bojājumu nodarīšanas vēsturiskā attīstība Latvijas teritorijā. Darba otrā nodaļa veltīta ārvalstu likumdevēju prakses apzināšanai attiecībā uz slepkavību un tīšu smagu miesas bojājumu, kas vainīgā neuzmanības dēļ bijis par iemeslu cietušā nāvei institūtu.Trešajā nodaļā darba autore analizē darba objekta jēdzienu, noziedzīgā nodarījuma sastāvu un kvalifikāciju. Veicot Krimināllikuma 116.panta un 125.panta trešās daļas nošķiršanu autore darbā izmanto tiesu nolēmumus, kas kalpoja par galveno avotu pantu norobežošanas problēmām praksē, kā arī darbā tika izmantotas dažādu valstu tiesību teorētiķu atziņas, mācību grāmatas, zinātniskie darbi un normatīvie akti. Kopsavilkumā tiek sniegti secinājumi par tiesu prakses problemātiku, kā arī autore sniedz savu viedokli un priekšlikumus attiecīgajos jautājumos. The Bachelor’s Degree Graduation Paper primary goal is to distinguish murder without aggravating or mitigating circumstances and the intentional infliction of serious bodily injury, that offenders culpable negligence was the reason of the victims death. The research is organized and structured so as to comprehensively find and summarize the proposals of the Criminal Law Article 116 and Article 125 Part Three separation and application in practice.
In the first chapter the author describes historical development of murder and serious bodily harm definitions in Latvian territory, using different criminal laws from the Year 1845 until nowadays. The second section of the Graduation Paper is devoted to the identification of foreign criminal laws, relating to murder and intentional serious bodily injury, in witch offenders culpable negligence was the reason of the victims death institute.
In the third and last chapter the author analyzes the concept of the object of the work, composition of the crime and qualification. Managing to make distinction between Article 116 and Article 125 Part Three of the Criminal Law the author used the work of judicial rulings that served as the main source of the segregation problems in practice, as well in the work were used knowledge of different legal theorists, books, scientific works, laws and regulation.
The summary provides conclusions about problems of jurisprudence, as well as the author gives her views on specific matters.
