Mantošanas tiesības pirms Livonijas un Livonijas laika latviešu paražu, vācu zemes, romiešu un kanoniskajās tiesībās

Abstract

Bakalaura darba mērķis ir izprast mantošanas tiesību attīstību, to izmaiņas un to vietu dažādās tiesībās, kuru dažādība tagadējā Latvijas teritorijā pastāv pirms Livonijas un Livonijas laikā. Nozīmīgs faktors tēmas izvēlē ir vēlme izprast mūsdienu mantošanas kārtību, to kā radies mantinieku loks, saprast, kāpēc eksistē tieši šādas un ne citādas mantošanas normas, lai varētu salīdzināt spēkā esošās normas ar tām, kuras regulējušas mantošanu līdz šim. Darba mērķa sasniegšanai un izvirzīto uzdevumu izpildei analizēta kārtu sabiedrība viduslaikos, dzimtas un ģimenes nozīme mantošanā, dzimtas izcelsme un veidošanās, paražas, kuras noteica mantošanu senajās latviešu ciltīs, atšķirības starp vīriešu un sieviešu mantošanu, jaunākā un vecākā dēla mantošanu, mantošanas atšķirības starp dažādām sociālajām kārtām, atšķirības vācu zemes tiesībās un pilsētu tiesībās, romiešu un kanoniskajās tiesībās, kā arī mantinieku loka īpatnības katrā no apskatāmajām tiesībām. Tiek pielietota, vēsturiskā un salīdzinošā, pētniecības metode. Vēsturiskā pētniecības metode tiek pielietota, izpētot un analizējot vēsturiskos avotus un zinātnisko literatūru, kā arī normatīvos aktus. Salīdzinošā pētnieciskā metode tiek pielietota, veicot dažādu tiesību salīdzināšanu mantojuma tiesību ietvaros, īpaši pievēršot uzmanību katru tiesību noteiktajām mantošanas atšķirībām mantotāju lokā. Darba struktūra ir veidota, ņemot vērā Livonijā pastāvošo tiesību partikulārismu un atšķirīgu tiesību savstarpējo mijiedarbību noteiktā teritorijā un laika periodā. Pirms Livonijas laiks, kurā dominē paražu tiesības, tiek analizēts, lai parādītu vācu tiesību ietekmi un izmaiņas, kuras tās ievieš mantošanas tiesībās, gan attīstoties sabiedriskajai iekārtai, gan kolonizācijai ietekmējot šo tiesību institūtu. Apskatītas vācu zemes tiesības-feodālās lēņu tiesības un pilsētu tiesības, kā arī romiešu un kanonisko tiesību ietekme un to piemērošanas rezultātā radušās atšķirības mantošanas tiesībās gan pilsētās, gan laukos, gan attiecībā uz dažādām sociālām kārtām. Pamatojoties uz iegūtajām zināšanām un atziņām, var secināt, ka, izprotot Livonijas un pirms Livonijas laika mantošanas tiesību principus un tos ietekmējošos faktorus, var gūt priekšstatu par mantošanas tiesību mainīgumu, atkarībā no sociāliem, juridiskiem un ekonomiskiem apstākļiem, kā arī valsts politiskās iekārtas un reliģisko organizāciju ietekmes. This bachelor paper is aimed at, by examining direct and indirect primary sources, presentation of development of the inheritance law concept as well as changes and place thereof in the variety of laws existing on the territory of Latvia before Livonia existed and when Livonia existed. Choise of exactly this theme for the paper subject was to a large extent determined by a desire to understand the procedure of inheritance applied today, the mechanism of formation of a circle of lawful heirs, as well as to conceive why exactly these, not the other, inheritance norms exist in order to be able to compare the present and previous inheritance norms. In order to fulfil the set tasks, the thesis author analysed the class society in the Middle Ages, kindred and family inheritance, occurence of kindreds, the customs that influenced inheritance in old Latvian tribes, the differences in men and women inheritance, the inheritance in respect of a younger and an elder son, the inheritance differences between different social classes, the differences met in German land law and urban law, Roman and cano laws as well as the traits incidental to a circle of heirs within each of the described laws. Both historical and comparative research methods were used to prepare the thesis. The historical research method was used by studying and analysing historical and scientific source literature, and legislative instruments, too. The comparative research method was used by comparing different inheritance laws with placing special emphasis on inheritance differences existing within each law betwen a circle of heirs. The thesis was prepared taking into account legal particularism existing in Livonia as well as interaction of different laws that took place on that territory and within that period. The time preceding the Livonian war, when common law dominated, was analysed with a purpose to demonstrate the influence exerted by German law and the changes made in relation thereto in inheritance law as a result of development of the society mechanism and through colonization that affected this institute of law. There was examined German land law, which is feud law and urban law, was examined herein, as well as the influence made by Roman and canon law and the differences in inheritance law resulting from applicatioin thereof in both cities and the country, and in respect of different social classes, too. Based on the acquired knowledge and data it can be concluded that by studying the inheritance law principles before and at the time of Livonia as well as the factors that influenced them one can get an idea of changeability of the inheritance law depending on social, legal and economic circumstances, and on the influence made by state political apparatus and religious organization, too.
