Cilvēka audu un orgānu nelikumīga izņemšana

Abstract

Šā bakalaura darba mērķis ir izpētīt cilvēka audu un orgānu nelikumīgas izņemšanas problemātiku un piedāvāt identificēto problēmu iespējamos risinājumus. Lai sasniegtu darba mērķi, tika izvirzīti šādi uzdevumi: -apskatīt pētāmo jautājumu bioētikas kontekstā, lai pilnvērtīgāk izprastu tās vērtības, kuras ir jāaizsargā ar tiesību normām (de lege ferenda) – šā uzdevuma izpildei ir veltīta darba I nodaļa; -analizēt cilvēka audu un orgānu nelikumīgas izņemšanas kā noziedzīgā nodarījuma sastāvu, lai apzinātu tās problēmas, kuras pastāv pētāmā jautājuma regulējumā (de lege lata) Latvijas Republikā – šā uzdevuma izpildei ir veltīta darba II nodaļa; -izpētīt regulējumu atsevišķajās Eiropas Savienības valstīs, lai veiktu salīdzinošo analīzi ar regulējumu Latvijas Republikā – šā uzdevuma izpildei ir veltīta darba III nodaļa.

The aim of this bachelor’s work is to research the legal and ethical problems connected with the illegal removal of the human tissue and organs and to propose possible solutions. To achieve the aforementioned aim author settled the following tasks: - to research the illegal removal of the human tissue and organs taking into account the bioethical issues to understand those values that should be protected by law (de lege ferenda); - to analyze the illegal removal of the human tissue and organs as a criminal violation in regard to realize the problems connected with the law on the issue in the Republic of Latvia; - to research the regulation of the illegal removal of the human tissue and organs in several countries of the European Union.
