Nosacītai notiesāšanai kā krimināltiesību institūtam ir liela nozīme soda izpildes noteikšanā. To pierāda statistikas dati, no kuriem redzams, ka pusei no notiesātajām personām Latvijā piemērots sodu izciest nosacīti. Taču, lai piemērotu nosacītu notiesāšanu atbilstoši konkrētajiem lietas apstākļiem un konkrētajai apsūdzētajai personai, jāzin nosacītas notiesāšanas piemērošanas pamati un priekšnoteikumi. Pamati un priekšnoteikumi jāanalizē tiesas spriedumā un tie nosaka, vai nosacīta notiesāšana piemērojama.
Latvijā spēkā esošajā Krimināllikumā ir daudz nepilnību, kas tiek izmantotas tiesu praksē, uzlabojot apsūdzētā stāvokli nepamatoti. Tas noved pie noziedzīga nodarījuma recidīva.
Tāpēc autore bakalaura darba trīs nodaļās apskata svarīgākos nosacītas notiesāšanas pareizas piemērošanas faktorus, ņemot vērā arī nosacītas notiesāšanas ārvalstu regulējumu. Proti, pirmā nodaļa ir par nosacītas notiesāšanas piemērošanu, kas ietver gan nosacītas notiesāšanas jēdzienu, gan nosacītas notiesāšanas pamatu un priekšnoteikumu analīzi, otrā nodaļa ir par nosacīti notiesātajai personai uzlikto pārbaudes laiku, tiesas uzliktajiem pienākumiem, to atcelšanas iespējām un tiesas spriedumā noteiktā soda izpildi reāli, savukārt trešajā nodaļā apskatīti dažādu ārvalstu nosacītas notiesāšanas regulējumi, kā arī apsvērti potenciālie grozījumi Krimināllikumā, kas nodrošinātu nosacītas notiesāšanas, kā arī vispār kriminālsoda mērķu sasniegšanu.
Kopsavilkumā autore izsaka vairākus būtiskākas atziņas par kļūdām nosacītas notiesāšanas piemērošanā gan tiesu praksē, gan krimināltiesību teorijā. Lai tās novērstu, izteikti vairāki grozījumi Krimināllikumā, noteikta Krimināllikuma komentāru papildināšana nosacītas notiesāšanas pareizai izpratnei, kā arī kritizēts likumdevējs par 2008. gada 1.septembrī stājušos spēkā grozījumiem, likumā neiekļaujot pārejas noteikumus. Condional sentencing as criminal law institute is a major role in determining the execution of penalty. This is evidenced by statistics which show that half of the sentenced persons in Latvia has accommodated to serve the punishment conditionally. However, to accomodate a conditional sentencing according to the specific circumstances and the particular accused person, need to know the basics of the condiotional sentencing and their prerequisites. Basics and the prerequisites must be analyzed in the Judgement, and they determine whether a contional sentencing has applicated.
Many shortcomings are in the valid Crimanal Law in Latvia, which are used in judicial practice, improving the situation to an accused wrongly. This leads to criminal recidivism.
Therefore, the author, in three chapters deals with the main contional sentencing factors of the correct appplication, considering foreign regulation of conditinal sentencing. Namely, the first chapter talk about the application of conditional sentencing, which includes the notion of conditional sentencing, analysis basics and prerequisites of conditional sentencing, the second chapter talk about imposed probation to a condionally sentenced person, obligations of court, the possible cancellation and about the execution of punishment actually, while third chapter deals with varios regulationms of condiotional sentencing in the foreign countries, author has considerated potencional amendments to the Crimanal Law, which would achieve the aims of conditional sentencing and aims of criminal punishment generally.
In summary, the author offers a number of substantial insights about errors in the application of conditional sentencing in the jurisprudence and in the criminal theory. To avoid them, author has made several amendments to the Criminal Law, has definited supplements to commentary of Criminal Law to understanding conditional sentencing correctly, author has criticized the legislature about amendments which entered into force in September 1st, on 2008, but don’t included transional rules.
