Abstract

Bakalaura darba ar nosaukumu „Eksperts kriminālprocesā” mērķis ir izpētīt pašreizējo eksperta darbības reglamentējošos tiesību aktus, konstatēt trūkumus un izpētes gaitā rast ieteikumus šo problēmu risināšanā, kā arī izpētīt eksperta tiesības un pienākumus kriminālprocesā. Autors pētīja jautājumus, kas saistīti ar ekspertīžu iestāžu darbību un funkcijām, kā arī ekspertam nepieciešamo profesionālo kompetenču loku, eksperta izglītības organizāciju un izglītības saturu. Pētījuma gaitā iezīmējās vairāki problēmjautājumi, kuru risinājumu priekšlikumus autors sniedz darba noslēguma daļā. Šo priekšlikumu ieviešana sasniegtu arī darba noteikto mērķi - ekspertu darbību reglamentējošo tiesību aktu problēmu risināšana un pilnveidošana. Pirmajā nodaļā tiek apskatīts eksperta institūta attīstības īss vēsturisks pārskats. Otrajā nodaļā - eksperta vispārējs raksturojums. Trešajā nodaļā - eksperta darbības tiesiskais regulējums Kriminālprocesa likumā un Tiesu eksperta likumā. Savukārt, ceturtajā nodaļā tiek apskatīta eksperta atbildība. Autors darbā analizē iespējamo Kriminālprocesa normu grozīšanu, lai harmonizētu šī likuma normas ar Tiesu eksperta likuma normām attiecībā uz eksperta regulējumu, jo pašlaik Kriminālprocesa likums ieņem atšķirīgas nostājas atšķirībā no speciālā Tiesu eksperta likuma. Darba gaitā autors secina, ka eksperts kļūst par amatpersonu, kura pilnvarota veikt kriminālprocesu procesa virzītāja uzdevumā, proti, mainījies eksperta statuss atšķirībā no spēku zaudējušā Kriminālprocesa kodeksa. Darbs sastāv no 54 lapaspusēm. Darba tapšanā tika izmantotas 17 literatūras vienības, 11 normatīvie akti un 18 interneta publikācijas. Darbā ir izmantotas šādas zinātniskās izpētes metodes: aprakstošā, salīdzinošā, vēsturiskā un analītiskā.

The Bachelor paper entitled “Expert in criminal proceedings” deals with the exploration of the current expert’s law governing activities, identifying gaps and searching for recommendations and solutions for these issues. The author of the present paper studies the issues related to the expertise as a whole and the functions of the expertise institutions; the expert’s necessary professional competencies have been investigated in the paper as well as the range of the expert’s educational organizations and educational content have been taken into consideration throughout the Bachelor paper. During the research, a number of challenges appeared; the solution suggestions of these challenges are provided in the final part of the paper. The realization of these issue questions would help to reach the goal of the paper – the solution of the problem that concerns the experts’ regulatory legislation. The first chapter of the paper comprises a brief historical overview of the development of the expert’s Institute. The second chapter reveals the expert’s general profile. The third chapter deals with the expert’s legal regulations in Criminal Law and Judicial Expert Law. Moreover, the fourth chapter deals with the expert’s responsibility. The author of the present paper analyzes the possible modification of the legal regulations of the Criminal Law proceedings to harmonize the regulations of this law with the regulations of the Judicial Expert Law in regard to the expert’s regulation because currently the Criminal Law occupies different positions, unlike the specific Judicial Expert Law. During the research, the author of the paper comes to a conclusion that the expert becomes an official who is empowered to manage criminal proceedings following the assignment of the procedure guide, that is, the expert’s status has been changed, unlike the prostrated Criminal Law code. The present Bachelor paper consists of fifty four pages. Seventeen literature units, eleven laws and regulations, and eighteen Internet publications have been used in the process of research. The research methods are the following: the descriptive, the comparative, the historical and analytical.
