ES pievienošanās 1950. gada Eiropas Cilvēktiesību un pamatbrīvību aizsardzības konvencijai: tiesiskais pamats un iespējamās problēmas

Jautājums par ES pievienošanos 1950.gada Eiropas Cilvēktiesību un pamatbrīvību aizsardzības konvencijai ir bijis aktuāls jau vairākus gadus, jo problēma skar ne tikai ES un Eiropas Padomes savstarpējās attiecības, bet ir svarīgs pašiem Eiropas iedzīvotājiem, tās pamatā ir arī politiskie jautājumi, tostarp divu organizāciju sadarbības un mijiedarbības procesi, ilgas politiskas diskusijas.
Darba pamatmērķis bija izpētīt, kādas problēmas liedza ES pievienoties Konvencijai 20. gs. beigās, kā ar laiku ir mainījies ES un to dalībvalstu viedoklis attiecībā uz šo jautājumu, kā arī izdarīt savus secinājumus saistībā ar pievienošanās nepieciešamību.
Darba gaitā autore secināja, ka pievienošanās norādīs uz ES cieņu pret cilvēktiesībām un to respektēšanu ne tikai pašas ES ietvaros, bet pat plašāk- visas Eiropas mērogā; ieviesis skaidrību attiecībās starp ES un Eiropas Padomi un vairos iespējas šo divu organizāciju sadarbībai, kā arī ES iestāsies jaunajā pozīcijā, lai kļūtu vēl demokrātiskāka, atklātāka, efektīvāka. The question of EU’s accession to the European Convention for the Protection of Human Rights and Fundamental Freedoms has been the live issue for many years not only because it affected the relationship between the EU and the Council of Europe, but also due to it being so relevant to the European citizens, and having important political issues – the process of two organisation’s cooperation and interaction, prolonged political discussions being among them.
The main goal of the study is to find out what problems forbid the EU to accede to the Convention during the end of the 20th century, how the member state’s and EU’s opinions on the accession have changed in the long run and, finally, to draw up conclusions as regards the necessity of accession.
The Author concluded that the accession would show EU’s respect towards human rights not only within the EU, but even wider- within the whole Europe; it will bring more clarity into the EU’s and Council of Europe’s relationship as well as will increase the possibility of cooperation. Moreover, the EU will enter into a new position to become more democtatic and effective.
