Bakalaura darbā autors pētījis plaši pazīstamas preču zīmes. Darbā tiek paskaidrots, kāpēc plaši pazīstamu preču zīmju īpašnieki bauda plašākas aizsardzības tiesības nekā preču zīmju īpašnieki, kuras nav plaši pazīstamas. Tas ir tādēļ, ka, lai preču zīme kļūtu plaši pazīstama, tās attīstībā tiek ieguldīti daudz līdzekļi, kā rezultātā ar šādu preču zīmi tās īpašnieks savas preces vai pakalpojums var pārdot daudz veiksmīgāk un nebūtu godīgi, ja citi, atdarinot plaši pazīstamo preču zīmi, varētu izmantot šīs priekšrocības par velti. Darbā ir arī izsekots plaši pazīstamu preču zīmju vēsturiskajai attīstībai.
Autors ir pētījis, kā nodibinās plaši pazīstama preču zīme, respektīvi, kādi kritēriji tiek ņemti vērā, lai varētu konstatēt, ka preču zīme ir plaši pazīstama, kādas institūcijas ir tiesīgas atzīt preču zīmi par plaši pazīstamu. Autors apskata likumu un starptautisko līgumu krtērijus, kā arī tiesu praksi un dažādas rekomendācijas, jo konkrēti kritēriji, kā noteikt vai preču zīme ir plaši pazīstama nepastāv.
Darbā tiek apskatīta tiesu prakse un nākas secināt, ka tiesas ne vienmēr rīkojas pēc vienām nostādnēm un precīzi piemēro normas par plaši pazīstamām preču zīmēm. Tā rezultātā plaši pazīstamas preču zīmes īpašnieka tiesību realizācija gan uz līdzīgām, gan citas klases precēm ir visai sarežģīta un ne vienmēr tiek pilnībā nodrošināta, taču situācijai ir tendece uzlaboties.
Autors nonāk pie secinājumiem, ka plaši pazīstamas preču zīmes izpratne turpina attīstīties un, piemēram, agrāk bija uzskats, ka strīda gadījumā ir nepieciešams, lai plaši pazīstama preču zīme būtu agrāka par pretstatīto zīmi, taču tagad pietiek ar to, ka pretstatītās zīmes īpašnieks rīkojies ne pēc labas ticības un negodprātīgi, proti, atdarinājis plaši pazīstamo preču zīmi, zinādams par tās eksistenci, kaut gan noteiktā teritorijā šī preču zīme nemaz nebija plaši pazīstama.
Tiek apskatīts, kādas tiesības izriet no plaši pazīstamas preču zīmes un nākas secināt, ka plaši pazīstamas preču zīmes īpašnieks bauda tās pašas tiesības, kuras visi preču zīmju īpašnieki, taču pastāv nelielas atšķirības, ja preču zīme ir plaši pazīstama, bet nav reģistrēta. The author of the bachelor’s work studied the topic of well-known trademarks. This work explains why well - known trademark holders enjoy greater rights than holders of trademarks which are not well known. This is because, to make a mark well known, holder has to invest a lot of endeavour in it and as a result of that holder of such mark can sell their goods much better and it would not be fair that others who imitate well-known mark could use these advantages for free. Historical development of well-known trademarks is also tracked in the work.
The author has studied, how a well-known mark is established, what criterias are taken into account in order to establish that the mark is well known and what is the body empowered to recognize if the mark is well-known. The author examines the law and international treaties criteria, as well as case law and various recommendations, because there are not direct criteria for determining whether a mark is well known.
The author examines case law and concludes that courts do not always act in one formulation and do not accurately apply the rules of the well - known trademarks. As a result, the rights of well - known trade mark owner and the realization of these rights in the matter of similar and other classes of goods are quite complex and not always fully available, but the situation has a tendece to improve.
The author reaches conclusion that the concept of well-known trademarks continues to evolve and for example there was previously a point of view that in the case of dispute it is necessary for well-known trade mark to be earlier than the opposing sign, but now it is sufficient that the owner of the opposing mark has not acted in good faith and made imitation of well - known mark, while being aware of its existence, although in the territory of dispute that mark was not well known yet.
The author examines those rights deriving from the well-known mark, and concludes that the owner of well-known trademark enjoys the same rights that all trademark owners, but there is a little difference, if a trademark is well known, but is not registered.
