Darba “Nedzimušas dzīvības un jaundzimuša bērna dzīvības krimināltiesiskā aizsardzība” mērķis ir veikt pētījumu un izstrādāt priekšlikumus nedzimušas dzīvības un jaundzimuša bērna dzīvības krimināltiesiskās aizsardzības pilnveidošanai.
Pirmajā nodaļā autors apskata cilvēka dzīvības sākuma momenta noteikšanu, uzsvaru liekot uz tā izpratni krimināltiesībās. Nodaļā tiek apkopoti un analizēti tiesībzinātnieku viedokļi par to, kad krimināltiesībās būtu jāsāk aizsargāt cilvēka dzīvību un kad tiek sākta cilvēka dzīvības aizsardzība saskaņā ar Krimināllikumu, nonākot pie secinājuma, ka dzīvības krimināltiesiskā aizsardzība sākas ar brīdi, kad bērns dzemdību procesā sāk parādīties no mātes dzemdību ceļiem.
Otrajā nodaļā autors apskata Krimināllikuma 119.pantu – Jaundzimuša bērna slepkavība. Nodaļā tiek apskatīta minētā nozieguma sastāva analīze, analizēta tiesu prakse par jaundzimuša bērna dzīvības atņemšanu un to kvalifikācijas problēmām saistībā ar citiem Krimināllikuma pantiem, nonākot pie secinājuma, ka dzemdību izraisīts psihiskais un fizioloģiskais stāvoklis tiek atzīts par dominējošo un ir par pamatu, lai slepkavību atzītu par izdarītu mīkstinošos apstākļos un kvalificētu saskaņā ar Krimināllikuma 119.pantu.
Trešajā nodaļā autors apskata grūtniecības pārtraukšanas medicīniskos un juridiskos kritērijus. Nodaļā tiek analizēts Krimināllikuma 135.pants, kurā paredzēta atbildība par neatļauta aborta izdarīšanu. Autors secina, ka minētais pants neparedz atbildību par grūtniecības pārtraukšanu kā tādu, bet gan tikai par aborta izdarīšanu, kas iespējams līdz grūtniecības 24.nedēļai, tādēļ būtu nepieciešams pilnveidot minēto pantu.
Ceturtajā nodaļā autors salīdzina Krimināllikuma normas ar ar ārvalstu krimināllikumu normām par jaundzimuša bērna slepkavību un grūtniecības pārtraukšanu, lai gūtu pēc iespējas plašāku un pilnīgāku redzējumu, uz kuru pamata tiek rasti priekšlikumi Krimināllikuma pilnveidošanai.
Kā galveno problēmu autors izvirza to, ka Krimināllikums aizsargā tikai dzimstoša bērna tiesības uz dzīvību un sievietes dzīvību un veselību, bet netiek aizsargātas augļa tiesības piedzimt, tādēļ būtu nepieciešams papildināt Krimināllikumu ar normām par dzīvības aizsardzību, kamēr vēl nedzimušais bērns atrodas mātes miesās. The aim of the bachelor’s work “Protection of unborn and newborn child’s life in criminal law” is to work out proposals for improvement of protection of unborn and newborn child’s life in Criminal Law.
In the first chapter the author writes about the commencement of the child’s life; the determination of it, putting emphasize on it in Criminal Law. In this chapter there are summarized and analysed points of view of protection of human’s life in Criminal Law: when it should be started and when it is started according to Latvian Penal Code (Penal Code). In the end of the chapter the author comes to conclusion that protection of child’s life starts with the moment of beginning of the accouchement.
In the second chapter author discusses the paragraph 119 in Penal Code: newborn child’s murder. Author analyses this crime; analyses legal proceedings of newborn murders. In this chapter author concludes that murder can be acknowledged as the murder commited in extenuating circumstances due to physical and physicological condition after the giving birth of the child’s and can be qualified according to paragraph 119 in Penal Code.
In the third chapter author deals with medical and juridical standards of ceasing of pregnancy. Author analyses paragraph 135 in Penal Code which talks obout the responsibility on illegal abortions. Author concludes that this paragraph unforesees the responsibility on ceasing of pregnancy but foresees just the responsibility on performing the act of abortion (that is allowed till 24th week of pregnancy). That is why this paragraph should be improved.
Author compares the norms of murder of the newborn child and the cease of pregnancy to get the complete insight in the Latvian Penal Code to compare the same norms of Penal Code abroad in the fourth chapter.The main problem in author’s opinion is that the Penal Code protects the rights of the newborn child (before and after the birth) and the women’s rights on their health and life, but the rights of the foetus are not protected. At the end author suggests to supplement the Penal Code with norms about protection of foetus, while it is in his mother’s body.
