Bakalaura darba temats ir brīvības atņemšanas soda piemērošana nepilngadīgajiem. Bakalaura darbā autore izpētīja nepilngadīgā jēdzienu krimināltiesībās Latvijā un ārvalstīs, nepilngadīgo noziedzības raksturojošās pazīmes, soda piemērošanas nepilngadīgajiem vispārīgo raksturojumu un brīvības atņemšanas soda nozīmi soda piemērošanā nepilngadīgajiem.
Brīvības atņemšanas sods ir viens no visbargākajiem soda veidiem, jo persona tiek izrauta no ierastās vides, tiek izolēta no sabiedrības un nepilngadīgajiem netiek nodrošināta normāla attīstība.
Darba izstrādes gaitā autore nonāca pie secinājumiem, ka brīvības atņemšanas sods nav tas labākais soda veids nepilngadīgajiem likumpārkāpējiem, bet ja noziedzīgais nodarījums ir smags un bīstams sabiedrībai, tad brīvības atņemšana ir attaisnojama, un tā jāpiemēro pēc iespējas uz īsāku laiku un tās laikā jāveic audzinošs darbs ar nepilngadīgo likumpārkāpēju. Tiesām pēc iespējas vairāk būtu jāpiemēro KL piedāvātas alternatīvas brīvības atņemšanai kā piespiedu darbu, naudas sodu vai audzinoša rakstura piespiedu līdzekļus, jo tādējādi labāk varēs sasniegt soda mērķi un nepilngadīgais netiks izolēts no sabiedrības. The theme of the bachelor’s work is „Enforcement of Imprisonment as a Way of Penalty for Juveniles”. During the research the author investigated the concept of the juvenile in criminal law in different countries. Also the author investigated indications of juvenile delinquency, the general characterization of penalty enforcement for juveniles and enforcement of imprisonment as a way of penalty for juveniles.
Imprisonment is one of the most severe punishment, because the convict is isolated from his usual environment and society. If a juvenile has been imprisoned, he is not provided with an opportunity for normal development.
During the research the author concluded that: 1) imprisonment is not the best way of penalty for juveniles; 2) if the juvenile has committed a grave crime, then the imprisonment can be justified; 3) the term of juvenile’s imprisonment should be as short as it is possible and some educational work has to be done.
Courts in their verdicts should enforce other ways of penalty. For instance – forced labour, fine, educational measure of compulsion. By applying them the purpose of the penalty will be achieved. Also the juvenile will not be isolated from the society.
