Bakalaura darbā tiek pētīta vispārējo tiesību principu nozīme tiesību normu hierarhijas kontrolē. Bakalaura darba mērķis ir pamatot darbā izvirzīto tēzi, ka Satversmes tiesai ir jāvērtē ārējo normatīvo tiesību aktu, to skaitā Satversmes formālā nozīmē, atbilstību vispārējiem tiesību principiem.
Bakalaura darbs ir strukturēts divās daļās. Pirmajā daļā tiek noskaidrots tiesību normu hierarhijas jēdziens un vispārējo tiesību principu juridiskais spēks. Otrajā daļā autors analizē Satversmes tiesas un ārvalstu konstitucionālo tiesu praksi normatīvo tiesību aktu atbilstības vispārējiem tiesību principiem izvērtēšanā.
Bakalaura darba izstrādē autors izdara secinājumu, ka vispārējie tiesību principi ir tiesību normas ar augstāko juridisko spēku tiesību sistēmā. Ārējo normatīvo tiesību aktu atbilstību vispārējiem tiesību principiem ir jāvērtē Satversmes tiesai. Tādējādi Satversmes tiesas kompetence ir paplašināma, paredzot, ka Satversmes tiesa izskata lietas par ārējo normatīvo tiesību aktu atbilstību Satversmei vai vispārējiem tiesību principiem, kā arī lietas par Satversmes atbilstību vispārējiem tiesību principiem. The purpose of this bachelor’s thesis titled General principles of law in constitutional review, is to prove that the Constitutional Court of the Republic of Latvia should review cases regarding compliance of normative acts including the Constitution with general principles of law.
In the first section of the bachelor’s thesis the author surveys the theory of hierarchy of legal norms and the legal force of general principles of law. In the second section the author analyses constitutional jurisprudence dealing with compliance of normative acts with general principles of law.
Consequently, it is concluded that general principles of law are the legal norms of the highest legal power in the system of law. The Constitutional Court of the Republic of Latvia must review compliance of normative acts with general principles of law. Therefore the competence of the Constitutional Court of the Republic of Latvia should be expanded so that it would include the review of compliance of normative acts with the Constitution or general principles of law, as well as the compliance of the Constitution with general principles of law.
