Preču vai pakalpojumu zīme ir viens no intelektuālā īpašuma veidiem. Preču zīme ir kļuvusi arī par nozīmīgu ekonomisku vērtību. Turklāt ir tendence pieaugt reģistrēto preču zīmju skaitam un līdz ar to arī strīdiem starp preču zīmju īpašniekiem. Strīdi par līdzīgām preču zīmēm pārsvarā rodas divu iemeslu dēļ – komersants reģistrējot preču zīmi iepriekš nav pārliecinājies vai pastāv līdzīga preču zīme vai arī komersants to dara apzināti, lai maldinātu patērētāju.
Šis bakalaura darbs ir veltīts līdzīgu preču zīmju izpētei, to kritēriju konstatēšanai un analīzei, kā arī, balstoties uz analīzi, sniegt priekšlikumus normatīvo aktu pilnveidošanai.
Līdzīgu preču zīmju kritēriji likumā nav minēti, tādēļ kritēriji ir jāveido tiesību zinātnei un tiesu prakse. Preču zīmju līdzība ir jāvērtē no dažādiem aspektiem, bet tajā pašā laikā arī kopumā, jo atsevišķa, no kopuma izrauta preču zīmes detaļa nevar noteikt to, ka preču zīmes ir vai nav līdzīgas.
Bakalaura darbs sastāv no trim daļām. Pirmajā nodaļā ir vispārīgi apskatīta preču zīme, terminoloģijas atšķirības un neprecizitātes, kā arī preču zīmju iedalīšanu. Otrajā nodaļā ir apskatīti kritēriji, kas nosaka preču zīmju līdzību. Trešajā nodaļā ir apskatīta līdzīgu preču zīmju tiesu praksē Latvijā. Trade or service mark is one of the intellectual property types. In the recent years trademarks have gained a substantial economic value. Furthermore there is a tendency for the number of registered trademarks to increase, thus the amount of disputes between trademark owners also increase. Disputes of similar trademarks exist for two reasons – businessmen registering the trade mark have not previously verified the existence of a similar mark or businessmen registering a similar trademark with an intention to mislead the consumer.
This graduating work is devoted to the topic of similar trademarks – exploration, establishing meaningful criteria for them and analysis. Finally, to give a proposal, based on the analysis, to improve the laws and regulation.
The criteria for similar trademarks are not incorporated in the law, therefore they should be developed in the science of jurisprudence or in legal practice. Similarity of marks must be assessed from different viewpoints, but in the same time on the whole of these different angles. The judgment cannot be based on a small part of the trademark that is removed from the whole image.
The graduating work consists of three chapters. The first chapter is devoted to finding differences of terminology and classification of trademarks, the second chapter examines the criteria of similar trademarks, while the third chapter examines the disputes of similar trademarks in Latvia.
