Kriminālatbildība par piesaistību noziedzīgam nodarījumam

Abstract

Bakalaura darbā “Kriminālatbildība par piesaistību noziedzīgam nodarījumam” ir apskatīta piesaistības noziedzīgam nodarījumam institūta vēsturiskā attīstība, tā būtība Latvijas krimināltiesībās, kā arī pētāmā institūta līdzība un atšķirība no līdzdalības. Darbā ir ietverta trīs piesaistības institūta veidu sastāva analīze - iepriekš neapsolīta slēpšana, neziņošana par noziegumu un noziedzīgā kārtā iegūtas mantas iegādāšanās un realizēšana, kā arī veikta Latvijas tiesu prakses analīze un pētāmā institūta regulējums ārvalstu krimināllikumos. Bakalaura darbā ir izmantota dažāda Latvijas un ārvalstu krimināltiesību literatūra, kā arī sniegts autores viedoklis attiecībā uz pētāmā institūta attīstības perspektīvām.

The Work “Criminal liability of the attachment to crime” estimates an issue about the development of the institute of the attachment to crime and its essence in Criminal law, similarity and difference between the attachment to crime and joint participation. The Work contains analysis of the constituent elements of the three kinds of the attachment to crime - concealing without prior promise, acquisition and sale of property obtained by way of Crime and failing to inform of Crimes; analysis of Latvian jurisprudence and comprehensive overview of legislative regulation for the attachment to crime in criminal laws of other countries. Bachelor work is based on information found in different sources of Latvian and foreign literature of criminal law. The Work includes also opinion about the improvement of the institute of the attachment to crime.
