Administratīvā procesa problemātika ārzemnieku nodarbināšanai Latvijā.

Abstract

Bakalaura darba nosaukums ir “Administratīvā procesa problemātika ārzemnieku nodarbināšanai Latvijā”. Darba mērķis ir analizēt pastāvošo ārzemnieku nodarbinātības regulējumu Latvijā, noskaidrojot būtiskākos trūkumus migrācijas un sociālo tiesību jomā. Atbilstoši šim mērķim autors izvirza šādus darba uzdevumus: 1.Analizēt Latvijas un ārvalstu tiesību aktus, starptautiskos dokumentus un citus tiesību avotus ārzemnieku nodarbinātības jomā; 2.Izvērtēt tās administratīvās procedūras, kas jāveic darba devējam, lai nodarbinātu ārzemnieku, salīdzinājumā ar iespējamo ieguvumu; 3.Salīdzināt ārzemnieka un Latvijas pastāvīgā iedzīvotāja nodarbinātības nosacījumus migrācijas un sociālo tiesību jomā; 4.Analizēt pašreizējās politikas iniciatīvas migrācijas jomā un izvērtēt tajās ietvertos priekšlikumus; 5.Sniegt priekšlikumus un ieteikumus pašreizējās situācijas ārzemnieka nodarbinātības jomā uzlabošanai no administratīvi procesuālā viedokļ. Pirmajā nodaļā autors analizēs ārzemnieku migrācijas nodarbinātības tiesisko regulējumu Latvijā. Otrajā nodaļā autors aprakstīs formālo uzturēšanas atļauju izsniegšanas kārtību. Trešajā nodaļā tiks apskatīti nodarbinātības un migrācijas nosacījumi, kas darba devējam jāizpilda Latvijas teritorijā, lai tiesiski nodarbinātību ārzemnieku. Ceturtajā nodaļā, ievērojot pastāvošo darbaspēka trūkumu konkrētās nozarēs Latvijas tautsaimniecībā, autors analizēs iespējamos ārzemnieku nodarbinātības politikas scenārijus. Darba apjoms ir 54 lappuses, darbs sastāv no 4 daļām. Izmantotās literatūras un juridisko aktu sarakstā iekļauti 34 avoti.

The thesis is entitled "Administrative process problems in immigration field”. The aim of the thesis is to analyze an existing regulation of employment for foreigners in Latvia, identifying the main weaknesses in the field of migration and social rights. According to the aim of the thesis, author proposes the following tasks: 1.To analyze Latvian and foreign legislation, international documents and other sources of legislation in the field of foreign employment; 2.To apprise administrative procedures for employers to employ foreigners in Latvia based on benefits they can get; 3.To compare foreigner and Latvian citizen employment conditions in the field of migration and social rights; 4.To analyze politic initiatives in the field of migration and to evaluate proposals that are included; 5.To give suggestions and recommendations for improvement of the current situation in the field of employment from the viewpoint of administrative processes. The results of the theses are presented in four chapters. In the first chapter the author presents analysis of legislation in migration for foreigners in Latvia. The second chapter presents an overview in which the author describes the formal procedure for issuing residence permits. In the third chapter the author describes employment and migration conditions for employers in Latvia for legal employment of foreigners in the territory of Latvia. In the fourth chapter, based on existing problems of the labour force in certain sectors in the Latvian economy, the author presents an analysis of possible future scenarios in the politics of foreigner employment in Latvia. The thesis consists of 54 pages, presented in 4 chapters. The bibliography and list of legal acts includes 34 sources.
