Bakalaura darba „Atlīdzinājums administratīvajā procesā” mērķis ir izanalizēt aktuālākos problēmjautājumus tiesiskā regulējuma piemērošanā, lemjot, vai personai piešķirams atlīdzinājums par nodarīto kaitējumu ar administratīvo aktu vai iestādes faktisko rīcību. Darbs sastāv no piecām nodaļām, kurās tiek raksturots personas tiesību uz atlīdzinājumu saturs un tiesiskais pamats, izvērtējot minēto tiesību ierobežojumu atbilstību Satversmei, kā arī izvērtējot tiesību uz atlīdzinājumu īpatnības administratīvā pārkāpuma procesā.
Bakalaura darbā galvenokārt tiek analizēts gan Administratīvā procesa likums un Valsts pārvaldes iestāžu nodarīto zaudējumu atlīdzināšanas likums, gan administratīvo tiesību doktrīnā, Satversmes tiesas un Latvijas Republikas dažādu instanču administratīvo tiesu praksē nostiprinātās atziņas attiecībā uz atlīdzinājumu administratīvajā procesā.
Izstrādājot darbu, autore ir izvirzījusi vairākus secinājumus un priekšlikumus praksē sastopamo problēmu risināšanai. Autore secinājusi, ka būtiskākās problēmas praksē, piemērojot tiesisko regulējumu attiecībā uz atlīdzinājumu administratīvajā procesā, ir nevienveidīga tiesību normu interpretācija, proti, dažkārt normas, kas skar atlīdzinājumu, tiek gramatiski tulkotas, tādējādi liedzot personai atlīdzinājumu, piemēram, tiesiska administratīvā akta vai iestādes faktiskās rīcības gadījumā vai iestādes procesuāla lēmuma gadījumā.
Tāpat autore darbā vērš uzmanību, ka personai atlīdzinājuma pieprasīšanai administratīvā pārkāpuma lietā, kuru skata rajona (pilsētas) tiesas tiesnesis, ir nepieciešams iziet otru procesu, kas būtiski atšķiras no kārtības atlīdzinājuma pieprasīšanai, ja administratīvā pārkāpuma lietu skata iestāde vai tiesa. Līdz ar to darbā tiek izvērtēts, vai vispārējās jurisdikcijas tiesa varētu lemt par atlīdzinājumu, kas no privātpersonas viedokļa būtu efektīvāks tiesību aizsardzības process. The purpose of the master `s work" Compensation in administrative procedure " is to analyze the most current issues for law adaptation in deciding whether a person has to be allocated the compensation for damage caused by administrative act or an actual action of an institution. The work consists of five chapters, in which is described the content of the person's right to compensation and the legal basis for the assessment of the restriction on the right according to the Constitution and the peculiarity of compensation in process of administrative delict.
In the master’s work are mainly analyzed the Administrative procedure act, the Act of compensation of the public government institutions, the administrative law doctrine and the adjudgement concerning the compensation of the administrative process in fixed practice of the Constitutional court and the administrative court of the various instance of the Republic of Latvia.
In developing the work, the author has made several conclusions and recommendations to solve problems that are encountered in practice. The author has concluded that the most important problems in practice, applying the legal framework for the compensation in administrative process, are a non-uniform interpretation of the norms of law, that is, in some cases, those are literally translated, thereby preventing the person a compensation, for example, in case of an administrative act or an institution’s actually action or an institution’s procedural decisions.
Similarly the author draws attention that the person that requests compensation in administrative case, which views the district (city) court judge, has to lead out a second process, which significantly differs from the procedures of requesting compensation if the administrative delict case is viewed by the authority or the court. Consequently, the author assess if the court of common jurisdiction could rule on the compensation that from the individual point of view would be more effective law enforcement process.
