Šajā darbā tiek pētīts iespējamais tautas vēlēta prezidenta ievēlēšanas process Latvijā. Tiek pētīts Ārvalstu Konstitūciju un likumu regulējums attiecībā uz valsts prezidenta ievēlēšanas procesu.
Darbā salīdzināts vairāku valstu regulējums, kurās jau pastāv tautas vēlēta prezidenta tiesību institūts, par pamatu ņemot demokrātiskās Eiropas valstis. Aplūkotās valstis ir Lietuva, Polija, Somija, Īrija, Islande, Bulgārija, Austrija un Horvātija. Atsevišķos aspektos apskatīts arī citu valstu tiesiskais regulējums.
Darba pirmā nodaļa aplūko prezidenta amata kandidātu pieteikšanu, kā arī kandidātiem izvirzāmās prasības. Darbā tiek izvērtēts un meklēts Latvijai piemērotākais modelis. Darbā tiek pretstatītas to subjektu tiesības, kas varētu pieteikt prezidenta amata kandidātus. Uzraudzības funkcijas un vēlēšanu organizācija būtu nododama Centrālajai vēlēšanu komisijai, kas arī pārbaudītu kandidātu iesniegtās ziņas un parakstus, kā arī atbilstību likumiskajiem kritērijiem.
Otrajā nodaļā apskatīta priekšvēlēšanu kampaņa kā tautas vēlēta prezidenta vēlēšanu procesa sastāvdaļa. Tiek aplūkoti iespējamie priekšvēlēšanu kampaņas finansēšanas modeļi. Darbā izdarīts secinājums, ka priekšvēlēšanu kampaņā būtiski ir izstrādāt tādu regulējumu, lai visiem kandidātiem būtu vienādas iespējas prezentēt sevi un veikt aģitāciju.
Trešajā nodaļā ir paredzēts noteikt par pamatu divu kārtu prezidenta vēlēšanu sistēmu. Neņemot par praksi citu valstu regulējumu ir aprakstīts iespējamais regulējums Latvija. Noteikts, ka ārkārtas vēlēšanas būtu rīkojamas, ja esošais prezidents atsakās no amata, nomirst vai ir ticis atlaists. Current article is to study a possible nationally elected president election process in Latvia. It is explored the foreign constitution law regulations in relation to the presidential election process.
The study compares a number of national law regulations where the nationally elected President Institute already exists on a basis of democratic European countries. The main observed countries are Lithuania, Poland, Finland, Ireland, Iceland, Austria, Slovenia and Croatia. In regards to the other aspects of the work, the law regulations of the other countries are also observed.
The first chapter is aimed to explore presidential candidate’s application (registration), as well as the requirements for candidates. The works is looking at assessing and evaluating appropriate model for Latvia. Actual work compares the rights of subjects, who can apply for presidential candidates. Supervisory functions and organization of the elections would be provided by the Central Election Commission, which also verifies the information provided by candidates and signatures, as well as of legislative compliance with established criteria.
The second section investigates with the pre-election campaign as the electoral stage of the presidential election process. Consideration is given to the possible election campaign funding. The paper concludes that the campaign is essential to develop a framework to allow all of the candidates equal access and opportunities to present themselves to the voters and carry out their campaigning.
The third section establishes the basic grounds of two-round presidential election system. Looking through practice of other countries there is described the possible provisions to be stated in Latvia. The paper deals with possible amendments to be made in law to establish the procedure of a nationally elected president. This section also develops the concept of extraordinary elections that could be held in case the current president resigns, dies or has been released.
