Eiropas Kopienas preču zīmes tiesiskais regulējums un problemātika

Abstract

Darba tēma „Eiropas Kopienas preču zīmes tiesiskais regulējums un problemātika” izvēlēta, jo šobrīd intelektuālo tiesību jomas profesionāļu vidū izvērtusies diskusija par to, vai Kopienas preču zīmes tiesiskais regulējums un tā sniegtās priekšrocības Kopienas preču zīmes īpašniekam nepiešķir pārāk lielas tiesības. Izstrādājot bakalaura darbu, tā mērķis bija noskaidrot un izpētīt aktuālākos Kopienas preču zīmes problēmjautājumus, analizēt uzņēmējam sniegtās Kopienas preču zīmes priekšrocības un to pamatotību, kā arī Kopienas preču zīmju sistēmas ietekmi uz nacionālo preču zīmju sistēmām, īpašu uzmanību veltot Kopienas preču zīmes faktiskās izmantošanas un reputācijas pierādīšanai iebilduma procedūras ietvaros. Pirmajā nodaļā, atspoguļojot Kopienas preču zīmes teorētisko bāzi, autore analizē uzņēmējam sniegtās Kopienas preču zīmes priekšrocības, kā arī sarežģījumus, ar ko komersantam var nākties saskarties Kopienas preču zīmes reģistrācijas procesā. Darba otrajā nodaļā autore, analizējot Eiropas Savienības tiesas un nacionālo intelektuālā īpašuma iestāžu lēmumus, apskata faktiskās izmantošanas un reputācijas pierādīšanu iebilduma procedūras ietvaros, īpašu uzmanību veltot tieši teritoriālā aspekta pierādīšanai. Bakalaura darba trešajā nodaļā autore vērtē Patentu valdes Apelācijas Padomes lēmumus attiecībā uz Kopienas preču zīmes faktiskās izmantošanas un reputācijas pierādīšanu iebilduma procedūras ietvaros un to, kā Apelācijas padomes lēmumus šajā jautājumā ietekmējusi Eiropas Savienības tiesas prakse.

The theme of this bachelor thesis is „Legal Framework and Issues of European Community Trademark”. The author has chosen the topic because among the professionals of the area of intellectual rights the discussion has arisen, if the legal framework of Community trade mark and benefits granted by it does not provide too large rights to its owner. The purpose of this thesis therefore was to identify and explore the most actual issues of Community trademark, to analyse the benefits provided to entrepreneurs by Community trademark and see their validity and justification, as well as analyse the impact of Community trademark on national trademark systems with a special emphasis on the actual usage of the Community trademark and verification of the reputation within the complaint procedure. In the first chapter author analyses the benefits provided to entrepreneur by Community trademark and complexities entrepreneur might face in the registration process of Community trademark, by reflecting the theoretical background of Community trademark. In the second part author describes actual usage of the Community trademark and verification of the reputation within the complaint procedure with a special emphasis on verification of the territorial aspect, by analysing judgments of European Union court and national institutions of intellectual rights. In the third part of the bachelor thesis author evaluates the judgments by Patent Office Board of Appeals in relation to actual usage of the Community trade mark and verification of the reputation within the complaint procedure and the way the decisions of Board of Appeals in these issues are impacted by European Union court practices.
