Publiskās ticamības princips ir vadošais princips zemesgrāmatās, kas nozīmē, ka zemesgrāmatas ir visiem pieejamas un to ierakstiem ir publiska ticamība.
Publiskās ticamības princips darbojas kopsakarā ar nekustamā īpašuma labticīga ieguvēja aizsardzības principu, tomēr teorijā nav vienotas labticīgā ieguvēja definīcijas, arī praksē jēdziena interpretācija atšķiras. Problēmas zemesgrāmatu procesā rodas arī tādēļ, ka netiek izprasta zemesgrāmatas kā institūta lielā loma, jo par īpašnieku atzīstams tikai tas, kas par tādu ierakstīts zemesgrāmatā. Prioritātes principa piemērošana zemesgrāmatās ir skaidri noteikta Zemesgrāmatu likumā, tomēr principa piemērošanā sastopamas kļūdas.
Darba mērķis ir izpētīt publiskās ticamības un prioritātes principa tiesisko regulējumu, juridiskajā literatūrā paustos dažādos viedokļus, tiesu praksi un pastāvošās problēmas.
Teorijas un tiesu prakses analīzes rezultātā secināts, ka nepieciešams veikt grozījumus Civillikumā, kuri definē labticīgā ieguvēja jēdzienu un regulē izņēmumu no labticīga ieguvēja aizsardzības principa, kā arī nepieciešams veicināt personu griezties zemesgrāmatā nostiprināt savas īpašuma tiesības. The public confidence principle is the leading Land Registry principle which defines accessibility of Land registers for everyone and public credibility of records.
The public confidence principle operates in interrelation with the protectional principle of the real estate acquirer in good faith, though there is no clear definition of an acquirer in good faith in theory and interpretation of the term differs in practice also. Problems in land registry process are caused also by misinterpretation of the role of the Land Registry as an institution since the owner of the property is entirely the one registered by the Land Register.
The target of the paper is the study of the legal regulation of the public confidence and priority principle, diverse opinions expressed in legal literature, practice of the court and existing problems.
Conclusion has been drawn as a result of theory and practice analyses that amendments should be made in the Civil Law defining the term of an acquirer in good faith and regulating exception under the protectional principle of the acquirer in good faith as well as providing promotion for persons to register their ownership rights in the Land Register.
