2009.gadā tika pabeigts Kopējā modelis (Draft Common Frame of Reference), kam jākalpo par vadlīnijām Eiropas Savienības dalībvalstu civiltiesību attīstības un unifikācijas jautājumos. Īpaša uzmanība vēršama uz pakalpojuma līguma regulējumu un pakalpojuma līguma veidiem, kuru kā jaunas līgumu grupas ieviešana Latvijas tiesībās nav viennozīmīga un būtu saistīta ar ievērojamām izmaiņām esošajā līgumu klasifikācijā.
Darbā autore pēta pakalpojuma līguma jēdzienu un veidus Kopējā modelī, esošo pakalpojuma līgumu regulējumu Latvijas normatīvajos aktos, salīdzina uzņēmuma līguma regulējumu ar pakalpojuma līguma regulējumu un kritiski vērtē pakalpojuma līguma veidu – būvniecības, projektēšanas, apstrādes, informācijas un padoma sniegšanas, glabājuma un aprūpes līgumu – izdalīšanas nepieciešamību. Darbā tiek sniegtas rekomendācijas par Latvijas tiesību sistēmai piemērotāko pakalpojuma līgumu klasificēšanu. In 2009 the Draft Common Frame of Reference was finished. It must serve as a guideline for developing and unifying the civil law of the European Union member states. Particular attention must be drawn to the legal order of service contracts and its modes because the implementation of service contracts as a new group of contracts in Latvian law is not unequivocal and is related with serious changes in current classification of contracts.
The author of the work analyses the concept and modes of service contract in scope of the Draft Common Frame of Reference, examines the current regulation of service contracts in Latvian laws, analyses and compares the legal order of contracts for work (enterprise contract) with the legal order of service contracts and critically evaluates the necessity of making a distinction between the different modes of service contracts – construction, processing, storage, information and advice, design and treatment. The author offers the most appropriate classification of service contracts for the Latvian legal system.
