Valsts atbalsta piešķiršanas prakses Latvijā atbilstība ES tiesībām

Abstract

Valsts atbalsts ir atbalsts, kas nāk no valsts resursiem un to piešķir valsts, vai tās pilnvarota institūcija. Valsts atbalsts ir viens no tirgus ekonomikas stimulēšanas veidiem. Noteikti uzņēmumi, valsts reģioni vai tirgus sektori spēj veiksmīgi attīstīties, pateicoties valsts radītajai salīdzinošai priekšrocībai ar citiem tirgus dalībniekiem. Latvijā valsts atbalsts ir salīdzinoši jauns process, kura normatīvo aktu bāze, līdz ar iestāšanos Eiropas Savienībā bija jāuzlabo un jāsaskaņo ar Eiropas Savienības direktīvām. Šobrīd ir pagājuši jau vairāki gadi kopš Latvija ir Eiropas Savienībā, tāpēc darbā tiek apskatīts vai valsts atbalsts Latvijā tiek piešķirts atbilstoši Eiropas Savienības tiesībām. Darba mērķis ir analizēt vai valsts atbalsta piešķiršanas prakse Latvijā ir atbilstoša Eiropas Savienības tiesībām. Darbā tiek apskatīts valsta atbalsta institūta jēdziens, valsts atbalsta regulējums Eiropas Savienības tiesībās un Latvijā, kā arī tiek apskatīta valsts atbalsta piešķiršanas prakse Latvijā un tās atbilstība Eiropas Savienības tiesībām. Tiek secināts, ka Latvijā ir veiksmīgi izstrādāta normatīvo aktu bāze, kas atbilst Eiropas Savienības prasībām, bet ir neliela tiesu prakse.

State aid is support that comes from state funds and it is granted by the state or an authorized institution thereof. State aid is one of the ways for market economy stimulation. Certain companies, state regions or market sectors can successfully develop due to the state created relative advantage against other market participants. In Latvia, state aid is a relatively new process the legislation of which required to be improved and complied with the directives of the European Union once Latvia joined the European Union. Currently, several years have passed since Latvia joined the European Union, therefore, the thesis examines whether state aid granted in Latvia is in accordance with European Union law. The goal of the theses is to analyze, whether the practice of state aid being granted in Latvia complies with the legislation of the European Union. The thesis views the institute of state aid, how state aid is regulated within the European Union and Latvia, and also includes analysis of the practice of state aid granted in Latvia and its compliance with European Union legislation. It is concluded that Latvia has successfully formed a legislative basis compliant with the requirements of the European Union, however, case law is poor.
