Mantiska kompensācija par fiziska aizskāruma rezultātā radītu nemantisko kaitējumu

Latvijā nepastāv vienota izpratne par to, kā būtu nosakāms nemantiskā (tajā skaitā morālā) kaitējuma kompensācijas apmērs lietās, kurās nemantisks kaitējums ir fiziska kaitējuma sekas. Nepastāv vienoti kritēriji nemantiskā kaitējuma vērtēšanā, kuri tiesām būtu jāņem vērā katrā lietā par nemantiskā kaitējuma kompensēšanu. Tādēļ tiesu praksē sastopamas lietas, kurās nemantiskā kaitējuma apmērs tiek noteikts bez pamatojuma vai ņemot par pamatu tikai dažus juridiskus apsvērumus, kas rada šaubas par tiesas spriedumu taisnīgumu.
Pētījuma mērķis ir, analizējot tiesu praksi lietās par fiziska kaitējuma rezultātā radītu nemantisko kaitējumu un izdarot secinājumus par nemantiska kaitējuma kompensāciju pamatotību tajos, apkopot kompensāciju apmēra noteikšanas kritērijus un veikt to kritisku analīzi, spriežot par to nozīmīgumu un savstarpējo pakārtotību.
Lai tiesas noteiktu atbilstīgu un taisnīgu kompensāciju par nemantisko kaitējumu, ir jāņem vērā kaitējuma smagums un sekas, kaitējuma nodarīšanas apstākļi, taisnīguma princips, kuram ir pakārtots arī atbildētāja materiālais stāvoklis, ka arī piespriestajai kompensācijai ir jāpilda individuālās un ģenerālās prevencijas funkcija. In Latvia does not exist unified understanding about how is determined non-material (including moral) damage compensation in matters in which non-material damage is the consequence of physical damage. There do not exist unified criteria for evaluation of non-material damage which must be taken into account by courts in each case about compensation of non-material damage. Therefore, in cases in court practice in which the amount of non-material damage is determined without grounds or taking as grounds only different legal considerations which raise doubts about righteousness of court judgements.
The aim of research, when analysing the court practice in matters about non-material damage caused as the result of physical damage and making conclusions about non-material damage compensation motivation in them, is to summarize the criteria for determining of amount of compensation and to carry out their critical analysis, deciding about their importance and mutual subordination.
In order for the courts to determine respective and just compensation for non-material damage, the level of damage and consequences must be taken into account, the circumstances of causing damage, the principle of righteousness to which is subordinated also the material condition of respondent, as well as the imposed compensation must carry out the function of individual and general prevention.
