Bakalaura darbu – Spīdzināšanas aizlieguma ievērošana Latvijā atbilstoši starptautisko cilvēktiesību līgumiem – izstrādāja Sintija Strautiņa.
Darba mērķis – sniegt analīzi par Eiropas Cilvēktiesību un pamatbrīvību aizsardzības konvencijas un Eiropas Konvencijas par spīdzināšanas un necilvēcīgas vai pazemojošas rīcības vai soda novēršanu aizsardzības mehānismiem, kā šīs konvencijas papildina viena otru un kā Latvija īsteno uzņemtās saistības, lai novērstu spīdzināšanu.
Darba uzdevumi – noskaidrot spīdzināšanas aizlieguma jēdziena vēsturisko attīstību; analizēt šajās konvencijās ietverto spīdzināšanas aizliegumu, izdarot secinājumus par spīdzināšanas raksturu; apskatīt Eiropas Cilvēktiesību tiesas un Eiropas Komitejas spīdzināšanas novēršanai nepieciešamību; piedāvāt iespējamos risinājumus valstij uzlikto pienākumu efektīvākai izpildei, lai novērstu tāda veida pārkāpumus, kas kvalificējami kā spīdzināšana.
Bakalaura darbs sastāv no četrām nodaļām. Darba pirmajā nodaļā tiek apskatīts spīdzināšanas aizlieguma pamatjēdziens un tā attīstība. Otrajā nodaļā analizēts spīdzināšanas aizliegums Eiropas Cilvēktiesību konvencijā. Trešajā nodaļā apskatīts Eiropas Konvencijas par spīdzināšanas un necilvēcīgas vai pazemojošas rīcības vai soda novēršanu saturs. Ceturtajā nodaļā apskatīts spīdzināšanas jēdziens Latvijā un starptautisko prasību ievērošana. The aim of the work - to provide an analysis of the protection mechanisms of European Convention on Human Rights and European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment, how these conventions complement each other and how Latvia is implementing the commitments undertaken in order to stop the torture.
Terms of reference - to clarify the prohibition of torture concept of historical development; to analyse prohibiting torture contained in these conventions, drawing conclusions about the nature of torture; to consider the necessity of the European Court of Human Rights and the European Committee for the Prevention of Torture; to propose possible solutions that requires to the State to more effective enforcement to prevent the kind of offenses that qualify as torture.
Bachelor’s work consists of four chapters. In the first chapter dealt with the prohibition of torture in the basic concept and development. The second chapter examines the prohibition of torture of the European Convention on Human Rights. The third chapter considers the content of the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment. The fourth chapter describes the concept of torture in Latvia and the consideration of the international claims.
