ES tiesiskais regulējums attiecībā uz nelegālajiem imigrantiem

Abstract

Attiecības starp Eiropas Savienības politiku un nelegālo imigrantu tiesībām joprojām ir saspringtas. Nelegālo imigrantu stāvoklis un tiesības, kas viņiem tiek nodrošinātas Eiropas Savienības politikas stratēģijā un atbildēs, joprojām ir „neredzamas”. Eiropas Savienībai ir jāatzīst, ka nelegālie imigranti ir viena no neaizsargātākajām sabiedrības grupām un ka arī viņiem ir tiesības. Nelegālo imigrantu tiesību ievērošanai un aizsardzībai jākļūst par centrālo jautājumu ES, un tā ir iekļaujama sociālās aizsardzības stratēģijās. Eiropas Savienība nevar arī turpmāk sniegt atbalstu tikai pilsoņiem un citām personām, kas likumīgi uzturas tās teritorijā, un atstumt pārējās personu grupas. ES ir jāizstrādā un jāpieņem politika attiecībā uz nelegālajiem imigrantiem, kura būtu balstīta uz pamattiesībām un kurā tiktu pārvarēti praktiski šķēršļi, kas kavē nelegālā imigranta piekļuvi veselības aprūpei, izglītībai, mājoklim un taisnīgiem darba apstākļiem visā Eiropas Savienībā.

The relationship between EU policy and the rights of undocumented migrants remains in tension. The status and rights granted to undocumented migrants continues to be ‘invisible’ in EU policy strategies and responses. European Union has to admit that undocumented immigrants are one of the most vulnerable groups in society and that they have rights. The rights of undocumented immigrants and their protection must become a central issue of the EU, and that they have to be included in social security policy. European Union can not continue to provide support only to citizens and other persons that lawfully reside within its territory and exclude other groups. The EU should develop and adopt policies on undocumented immigrants, which would be based on fundamental rights and which would overcome the practical obstacles that prevent undocumented immigrants’ access to health care, education, housing and fair working conditions throughout the European Union.
