Eiropas Cilvēktiesību tiesai, nosakot kaitējuma atlīdzību, nav izstrādāti noteikti kritēriji, pēc kuriem varētu skaidri noteikt, vai konkrētajā gadījumā ir pamats piešķirt atlīdzību un kas būtu jāņem vērā nosakot tās apmēru un veidu. Šī iemesla dēļ autore aplūko svarīgākos priekšnosacījumus, kuriem jāpastāv, lai persona varētu prasīt un arī saņemt atlīdzību par viņai radīto kaitējumu.
Darbā tiek aplūkota kaitējuma atlīdzības pieteikuma virzība, sākot ar paša pieteikuma pamatojuma svarīgākajiem pamatelementiem un beidzot ar sprieduma izpildi daļā par kaitējuma atlīdzību. Īpaši tiek analizēti kritēriji, pēc kuriem vadās Eiropas Cilvēktiesību tiesa, nosakot pamatu atlīdzības piešķiršanai, kā arī nosakot atlīdzības veidu un apmēru. European Court of Human Rights in determining reparation for damages has not developed definite criteria by which it could be clearly determined whether in the specific case there is a reasonable ground for granting a reparation, or not, and what should be considered when determining an extent and a type. Because of these reasons, the author views the main preconditions which must exist for the person to ask and to receive compensation for the damages.
In this work there is viewed the moving of application for compensation of reparation, starting with the most important basic elements of the application and ending with the estimation of the enforcement in the part of reparation for damages. Particularly are analyzed the criteria after which the European Court of Human Rights is guiding in determining whether there are grounds for granting the reparation or not, as well as determining the type and the extent of the reparation.
