Abstract

Darba autors, pamatojoties uz Starptautisko tiesību komisijas īpašā ziņotāja Zdzislava Galicka (Zdzislaw Galicki) sagatavoto pētījumu attiecībā uz aut dedere aut judicare, kā arī uz citu speciālistu, kā, piemērām, M. Cherif Bassiouni un Antonio Cassese pētījumiem, cenšas noskaidrot, kas ir aut dedere aut judicare saistības pamats (starptautiskais līgums, starptautiskās paražu tiesības, utt.) attiecībā uz atsevišķiem noziegumiem. Darba gaitā noskaidrots, ka aut dedere aut judicare nav tikai formulējums, bet ka tas ir saistīts ar starptautisko paražu tiesību izveidošanos un dažos gadījumos pat ar jus cogens normām, pamatojoties uz kurām aut dedere aut judicare neizpilde varētu izraisīt valstīm erga omnes atbildību.

The aim of this dissertation is to determine the juridical basis (an international treaty, international customs, etc.) of the application of the principle aut dedere aut judicare in connection with specific international crimes. The investigation is based on the reports of the International Law Commission’s Special Rapporteur Zdislaw Galicki on the question of aut dedere aut judicare and on the investigations of scholars such as M. Cherif Bassiouni and Antonio Cassese. The work will assemble evidence for the thesis aut dedere aut judicare is not only a common formula for treaties, but can also be related to international custom law and even with peremptory norms of international law, Which could develop into en erga omnes responsibility for a state in the event of a breach of those norms.
