Bakalaura darba „Nonāvēšana aiz neuzmanības” mērķis ir izpētīt Krimināllikuma 123. pantā paredzētā noziedzīga nodarījuma sastāvu, ar šo nodarījumu saistītos kvalifikācijas un norobežošanas problēmjautājumus, kā arī iepazīties ar ārvalstu praksi attiecībā uz nonāvēšanas aiz neuzmanības krimināltiesisko regulējumu. Darbā analizēta nonāvēšanas aiz neuzmanības norobežošana no slepkavības, kas izdarīta ar netiešu nodomu un tīša smaga miesas bojājuma nodarīšanas, kas vainīgā neuzmanības dēļ bijis par iemeslu cietušā nāvei. Pievēršanās tieši šiem norobežošanās problēmjautājumiem ir izskaidrojama ar to, ka tiesu praksē nav skaidras un vienotas izpratnes, kā norobežot minētos nodarījumus, tāpēc tiesas kļūdaini kvalificē noziedzīgus nodarījumus. Krimināltiesību zinātnē šis jautājums ir samērā maz izpētīts. Aplūkotas arī kvalifikācijas procesa īpatnības, kad citas personas prettiesiska nonāvēšana aiz neuzmanības notiek noziedzīgu nodarījumu ar komplicētu sastāvu izdarīšanas rezultātā, un tādu nodarījumu izdarīšanas rezultātā, kuru sastāvs neaptver kaitīgo seku – nāves - iestāšanos.
Izvirzīto mērķu sasniegšanai autors veica Latvijas un ārvalstu tiesību aktu izpēti, tiesu prakses analīzi un doktrīnā izstrādāto atziņu izpēti, kā arī izdarīja secinājumus un izvirzīja priekšlikumus. The goal of the Bachelor thesis “Homicide through negligence” is to investigate the constituent elements of a criminal offence set out in the section 123 of the Criminal law of Latvia, the qualification and delimitation issues related to this offence, as well as to get acquainted with the foreign practice in regard to criminal regulation of homicide through negligence. The paper analyses the delimitation of homicide through negligence from murder committed with indirect intent and intentional infliction of serious bodily injury, which, as a result of the negligence of the offender, has been the cause of the death of the victim. Investigation of these particular delimitation issues is explained by the fact that there is no clear and common understanding in case law of how to terminate the mentioned offences; therefore, courts classify criminal offences incorrectly. This question has been relatively poorly investigated in criminal law science. The characteristics of the qualification process have also been examined when the other person’s unlawful homicide through negligence is a result of criminal offence with complicated constituent elements and is also the result of such criminal offences when the constituent elements do not encompass harmful effect - death.
To achieve the set goals, the author has done research on the Latvian and foreign legislation, analysis of case law and investigation of the cognitions developed in the doctrine, as well as come to a number of conclusions and provided some proposals.
