Legāts mantojuma tiesībās

Abstract

Mūsdienu ekonomiskajos apstākļos, ir dabiski, ka persona nevar nepalikt neieinteresēta sava īpašuma liktenī tās nāves gadījumā. Šādā situācijā testaments un iespējams tajā iekļautais legāta novēlējums ieņem svarīgu lomu. Šajā darbā apskatīti legāta tiesību galvenie jautājumi kopsakarā ar Latvijas Republikas Civillikuma normām. Vērtēta situācija un apstākļi par pamatu ņemot tiesību normas un tiesu praksi. Darbā caurskatītas legāta tiesību problēmas, legāta interpretācija, jautājumi par legāta koncepciju un priekšmetu, kā arī tā dalībniekiem, tiesiskajām sekām pieņemšanas gadījumā, tiesisko kārtību atteikšanās gadījumā. Autore pievērsusi uzmanību arī jautājuma par legāta dažādajiem veidiem un pieaugumiem. Darba tēma sevī iekļauj ne tikai legāta juridiskos jautājumus, bet arī neskaidro raksturu un dabu. Darbā „Legāts mantojuma tiesībās” autore apspriež šobrīd aktuālu tēmu. Salīdzinošajai izpētei autore izmantojusi dažādus avotus un materiālus, piemēram, salīdzinot ar senās Romas impērijas tiesību normām. Darbā autore izmantojusi plaša spektra literatūru, lai izpētītu tēmas uzdotos jautājumus, kā arī analizējusi tiesu prakses materiālus. Darba nobeigumā autore nonāk pie secinājuma, ka daudzi legāta tiesību jautājumi nevajadzīgi sarežģīti un bieži vien atmetami. Daudz Civillikuma normas, kas skar legātu tiesības ir novecojušas, jo saglabājušās no 1930. Gadiem. Darba gaitā autore nonāk pie daudziem jauniem secinājumiem par legātu jautājumiem, atklājot gan konkrēto tiesību normu plusus, gan mīnusus, gan noderīgus, gan nevajadzīgus regulējumus.

Under present-day economical conditions, it is natural that a person cannot stay uninterested in its property’s destiny in case of the person’s death, and a testament along with the institution of legate, takes an important place. A review of legate’s general conditions in the conception of the Civil Law, evaluating the conditions that are appointed in the law and their expediency taking into account courts practice, is carried out in the work. The problems of the rights of legate, the legate’s interpretation, the question about legate’s antecedent role paying attention not only to the legate conception and subject but also to the legate participants, consequences that can appear because of the legate acceptance, the sequence in which the legate is obtained, accomplished and rejected are examined in the work. The author will also have a look into such questions as the legate separate types and the legate decrease. The theme of the work concerns the not only the juridical matters of legate but also its transcendental disposition. In this work “Legate within the rights of inheritance” the author discussed a theme, being so actual in nowadays. For comparative research the author have used different materials, for example, I considered legate and its problems comparing them to the times of the ancient Rome empire. The author used a large variety of literature for researches on the given theme and also analyzed materials of court practice. At the end of bachelor’s work the author come to the conclusion that a lot of questions regulating the rights of legate are quite compounded and unnecessary. A lot of civil law norms about the legate that are being preserved from the 30-ies are outdated. During the work, author comes to many new conclusions about the rights of legate, revealing both, the good and the bad, the availed and the unnecessary.
