Latīņu tipa notariāts Latvijā un tā funkcijas

Abstract

Bakalaura darbā „Latīņu tipa notariāts Latvijā un tā funkcijas” tiek apskatīta latīņu tipa notariāta vēsturiska attīstība, kas ļauj izprast notariāta funkcijas un to nozīmi mūsdienu notariātā Latvijā. Notariāts ir nepieciešams, lai zvērināti notāri, pildot notariālās darbības, veidotu saikni starp valsti un sabiedrību. Notariālās darbības, kuras piekrīt taisīt zvērinātiem notāriem, ir ietvertas Notariāta likumā, taču būtiski, ka, veicot notariālās darbības, zvērinātam notāram ir jāievēro notariāta funkcijas. Notariāta funkcijas ir – apliecināšanas funkcija un padomu došanas funkcija. Uzskatāmībai darbā tiek analizēts, kā apliecināšanas funkcija un padomu došanas funkcija tiek pielietota, taisot notariālo aktu un apliecinot paraksta īstumu. Tomēr pieredze rāda, ka nebūt ne vienmēr apliecināšanas funkcijas un padomu došanas funkcijas jēdziens un pielietošana tiek viennozīmīgi izprasts ne vien sabiedrībā kopumā, bet arī zvērinātu notāru vidū. Tādējādi nepieciešams veikt sabiedrības izglītošanas pasākumus, kā arī veikt pasākumus, lai zvērinātu notāri savā darbībā realizētu šīs funkcijas atbilstoši to paredzētajiem mērķiem, kas, savukārt, veicinātu efektīvāku personu tiesību, likumīgo interešu un valsts interešu aizstāvību. Izpētot un izanalizējot literatūru, normatīvos aktus un prakses materiālus par minēto institūtu, autore sniedz vērtējumu, atzinumus un priekšlikumus apzināto problēmu risināšanai, kā arī grozījumiem normatīvajos aktos. Darba izstrādes gaitā gūtās atziņas formulētas priekšlikumu formā nodaļu ietvaros, kā arī kopsavilkumā, formulējot tos tēžu veidā.

Bachelor work “Latin type notary in Latvia and functions of it” is devoted to examine Latin type notary historical development in Latvia, thus allowing also gathering the notary’s functions and importance in nowadays. Notary is essential part of legal institutions which ensures that sworn notaries executing their activities, forms the connection between state and society. Notarial activities that apply to certified notaries are stated in Law of Notary (Notariāta likums). However, essential is the fact that notaries must comply with notary’s office functions in pursuance of notaries’ tasks. The functions of notary are following: certification function and advisory function. In work is analyzed how do the certifications and advisory functions are being applied in the process of creation of notarial act and certificting the signature However, the witnessed situations show that not always the notion of certification function and advisory function is understood as well as applied in practice unequivocally. This problem is met not only in whole society, but also in the circle of certified notaries. This issue indicates to the necessity to educate society, as well as draws attention to the need of measures in order to have the common practices in work of notaries. The common way of working according to the essence of notarial functions would ensure the better advocacy of person’s personal rights and vested rights, and advocacy of state interests. Based on the research and analysis of literature, laws and regulations, and practice’s materials about institute of notary’s office, the work author gives the assessment, conclusions, and propositions for resolution of detected issues, as well as amendments to existing laws and regulations.
