Bakalaura darbs «Kūdīšana un provocēšana kriminālprocesā» veltīts «kūdīšanas» un «provocēšanas» jēdzienu un darbību satura analīzei, kā arī to izpausmēm praksē. Darbā tiek konstatēts, ka Kriminālprocesa likumā un Operatīvās darbības likumā, aizliegtas, taču pēc būtības līdzīgas, subjekta speciālo paņēmienu darbības, tiek terminoloģiski dažādi apzīmētas. Mērķis bija izpētīt vai šim apstāklim ir jebkāda praktiska nozīme, aplūkojot iespējamos problēmjautājumus un sekas, kas var rasties šo institūtu nepareizas piemērošanas un izpratnes rezultātā. Salīdzinot jēdzienu «kūdīšana» un «provocēšana» filoloģisko un juridisko nozīmi, tika izvirzīta tēze, ka pretruna būtu novēršama, izdarot grozījumus Operatīvās darbības likumā, vai arī skaidrojot abus šos jēdzienus un to robežas Kriminālprocesa likumā un Operatīvās darbības likumā. Tāpat darbā izvirzīti vairāki priekšlikumi kā būtu nodrošināma efektīvāka kontrole pār Speciālā izmeklēšanas eksperimenta un Operatīvā eksperimenta gaitu, nodrošinot personas tiesības uz taisnīgu tiesu.
Izvirzīto mērķu sasniegšanai autore veica Kriminālprocesa likumā un Operatīvās darbības likumā paredzēto speciālo eksperimentu analīzi, balstoties uz juridisko doktrīnu, Eiropas Cilvēktiesību tiesas judikatūras analīzi, kā arī uz atsevišķu krimināllietu materiālu izpēti. The bachelor paper Incitement and Instigation in Criminal Procedure deals with the concepts of Incitement and Instigation in terms of the content analysis of their conceptual and operational meanings as well as their manifestation in practice.
The paper establishes the fact that in Criminal Procedure Law and Investigatory Operations Law, prohibited but, in point of fact, similar, specific operational methods of a functionary are terminologically marked in different way.
The aim is to investigate if the mentioned above circumstance is practically relevant from the point of view of any crucial questions and consequences which may emerge from an incorrect adaptation and comprehension of the terms Incitement and Instigation.
Comparing the linguistic and legal meanings of the terms incitement and instigation, the author advances the thesis which states that the contradiction is preventable by the amendments in Investigatory Operations Law or by providing clear explanations of these terms and their boundaries in Criminal Procedure Law and Investigatory Operation Law.
In addition, the author gives several proposals for more efficient control over Special Investigation Experiment and Operational Experiment which are to provide a fair trial for the individual.
The author has examined the special experiments in the context of Investigatory Operations Law within the legal doctrine, case laws of the European Court of Human Rights as well as analysis of particular criminal cases.
