Kriminālsodāmas darbības ar cilvēku audiem un orgāniem

Abstract

Bakalaura darba tēma ir „Kriminālsodāmas darbības ar cilvēku audiem un orgāniem”. Autore izvēlējās šo tēmu, jo uzskata, ka Latvijā, kur pagaidām noziedzīgi nodarījumi ar cilvēku audiem un orgāniem ir maz izplatīti, tos ir iespējams novērst, pirms vēl nodarījumu apmēri pieaug. Šī darba mērķis bija noskaidrot par kādām nelikumīgām darbībām ar cilvēku audiem un orgāniem draud kriminālatbildībā, kā arī apskatīt starptautisko regulējumu un tiesisko regulējumu Latvijā, kā arī analizēt Krimināllikuma pantus, kas attiecas uz orgānu tirdzniecību un nelikumīgu audu un orgānu izņemšanu, salīdzinot regulējumu ar citām valstīm. Pateicoties biotehnoloģijas attīstībai cilvēkiem ar neārstējamām slimībām ir pavērusies iespēja cīnīties ar tām, pārstādot audus un orgānus. Kaut arī pastāv tāda iespēja, trūkst orgānu donoru, jo maz atrodas dzīvi donori, kuri būtu piemēroti un būtu gatavi ziedot kādu savu audu vai orgānu citam cilvēkam. Kā arī lai atrastu audus un orgānus no miruša donora, jāņem vērā aizgājēja dzīves laikā izteiktā griba, kā arī pēc viņa nāves tuvinieku atļauja vai aizliegums ņemt audus vai orgānus.

A criminal act of human tissues and organs. The author chose the topic because she believes that in Latvia, where the criminal offense regarding human tissues and organs is quite unusual, it is possible to eliminate such criminal acts before the extent of the offense increases. The purpose of this work is to find out about any illegal activities regarding human tissues and organs and the related criminal liability, to look at the international regulation and legislation in Latvia as well as to analyze the Criminal Law related to organ trafficking and the illegal removal of organs and tissues. The development of biotechnology for people with incurable diseases opens up possibilities to fight the diseases by transplanting the tissue and organs. Thought only few are actual living donors who are suitable and would be willing to donate any of their tissue or organs to other person, therefore the the lack of organ donors is still an ongoing problem. As well as to find a tissue and organs from deceased donors the person's will has to be taken into account, and after his/her death the relatives' permission or prohibition to take tissue or organs has to be considered.
