Saskarsmes tiesības

Abstract

Bakalaura darba tēma, ir „saskarsmes tiesības”. Autore apskatīs institūta tiesisko regulējumu gan Latvijas Republikā, gan ārvalstīs. Darba mērķis ir noskaidrot, vai mūsdienās pastāvošais saskarsmes tiesību institūta regulējums un tā nodrošināšana, kā arī izpilde Latvijā ir pietiekami efektīva. Darba uzdevumi: apskatīt un izpētīt esošo saskarsmes tiesību institūta regulējumu, izpildes mehānisma regulēju Latvijā, aplūkot atsevišķu valstu –Vācijas, Igaunijas, Lietuvas, Zviedrijas tiesisko regulējumu saskarsmes tiesību institūtam. Izpētīt saskarsmes tiesību institūta vēsturisko attīstību. Autore piedāvā novērtējumu, lai novērtu iespējamos problēmjautājumus, saistībā ar saskarsmes tiesību institūtu un tā izpildi. Piemēram, autore iesaka, noteikt konkrētus kritērijus, pēc kuriem būtu jāvērtē persona, kas vēlas iegūt tiesības uz saskarsmi. Tāpat autore piedāvā paplašināt bāriņtiesu darbinieku kompetenci lietās, kas saistītas ar saskarsmes tiesību noteikšanu.

The topic of the bachelor's thesis is „ Family access rights” The aim of the thesis is to inspect legal situation of family Access right institute of the Latvian law and to find out is the law is effective. Work task: inspect and find out legal situation of Access right institute of the Latvia law, of the Germany law, of the Sweden law, of the Estonia and of the Lithuania law. Author has proposed some ideas for more effective regulation for Access right, like, the author recommends to set specific criteria by which person who wishes to get access rights with child, would be evaluate.
