Tiesiskā ignorance kā tiesiskās apziņas deformācijas veids un tās samazināšanas iespējas

Abstract

Bakalaura darba „Tiesiskā ignorance kā tiesiskās apziņas deformācijas veids un tās samazināšanas iespējas” mērķis ir iepazīties un izpētīt tiesisko ignoranci kā tiesiskās apziņas deformācijas veidu, izvērtējot tās cēloņus un iespējamās samazināšanas iespējas Latvijā. Darbs sastāv no trīs nodaļām, kuru ietvaros tiek noskaidrots jēdziena „tiesiskā apziņa” izpratne tiesībās, izpētīts tiesiskās ignorances jēdziens un būtība, izvērtēti tiesiskās ignorances rašanās cēloņi Latvijā un izteikti priekšlikumus apzināto problēmu risināšanai. Kā galvenie tiesiskās ignorances cēloņi tiek izvirzīti vēsturiskie tiesiskās apziņas veidošanās aspekti, oficiālās informācijas pieejamība, dzīves līmenis, tiesību avotu kvalitāte, sadarbības un sabiedrības integrācijas trūkumu tiesību normu jaunrades procesā, kā arī juridiskās izglītības trūkums. Pēc autores domām tiesisko ignoranci iespējams samazināt, veicinot valsts varas sadarbību ar sabiedrību, uzlabojot dzīves līmeni, juridiskās izglītības kvalitāti, it īpaši masu mēdiju pārstāvju vidū, kā arī konstitucionāli nostiprinot principu, ka likuma nezināšana neatbrīvo no atbildības.

Bachelor's thesis "Ignorance of the law as a from of the legal consciousness deformation and the reduction options” aim is to learn and explore the ignorance of the law as a form of the legal consciousness, to assess its causes and possible reduction options in Latvia. It consists of three divisions, where is established the concept of legal consciousness, explored the concept and content of legal ignorance, evaluated causes of legal ignorance is Latvia and made proposals to the identified problems. As the main causes of legal ignorance are historical aspects, available official information, low standard of living, lack of integration in the innovation process of law. The author considers the legal ignorance can be reduced by encouraging cooperation between public authorities and civil society, improving the standard of living, quality of legal education, particularly among representatives of mass media, as well as strengthening the constitutional principle that ignorance of law does not exempt from liability.
