Tiesiskās problēmās Eiropas Parlamenta un Padomes Direktīvas 2006/123/EK ieviešanai Latvijā un citās ES dalībvalstīs

Abstract

Bakalaura darba "Tiesiskās problēmās Eiropas Parlamenta un Padomes Direktīvas 2006/123/EK ieviešanai Latvijā un citās ES dalībvalstīs" mērķis ir analizēt Direktīvas tiesību normas un tās vēsturisko attīstību, salīdzināt šīs normas ar Koncepcijas par vienas pieturas aģentūras principa ieviešanu valsts un pašvaldību pakalpojumu pieejamībā pausto problemātiku, kā arī izvērtēt citu Eiropas Savienību valstu praksi un salīdzināt to ar Latvijas situāciju. Mērķa sasniegšanai, autore darba četrās nodaļās noskaidro un analizē Direktīvas vēsturisko tiesību normu attīstību un tai uzstādītos mērķus, definē pakalpojuma jēdzienu, analizē Direktīvas likuma normas un ar to saistītos Eiropas Savienības dokumentus un pakārtotos dalībvalstu likumus, pēta vienas pieturas aģentūras struktūru un darbību, izvērtē Direktīvas darbības pozitīvās un negatīvās iezīmes, izvērtē citu Eiropas Savienības dalībvalstu praksi Direktīvas ieviešanā un veic salīdzinājumu ar Latviju, izdara secinājumus par paveikto darbu, un izsaka jaunus priekšlikumus problēmu risināšanai divu jaunu likuma pantu veidā, kuri fundamentāli atrisina visas ar Direktīvas ieviešanu saistītās problēmas.

The aim of paper “Legal problems in implementation of European Parliament and Council directive 2006/123/EK in Latvia and other EU member states” is to analyse legal norms of this directive and its historical evolution, as well as compare these norms with problems mentioned in to the implementation document of Conception about single multipurpose agency principle implementation in to state and municipalities. Moreover this analysis will be compared to the experience of other EU memberstates. To come to the conclusions the author determines and analyses historical evolution of the norms and their aims, defines the meaning of services, analyses legal norms of the directive and their respective EU documents, analyses single multipurpose agency structure and operation, analyses the experience of other EU member states in implementation process fo this directive, and compares it to the sitation in Latvia. In the end the author derives conclusions about the analysis and gives proposals for solving the problems in the form of two new articles in the existing laws that fundamentally solves the implementation problems of the Directive.
