"Vispārējie tiesību principi pašvaldību saistošajos noteikumos"
Vispārējo tiesību principu lietošana pašvaldību saistošo noteikumu sastādīšanā un realizēšanā praksē ir svarīga tiesiskuma sastāvdaļa, jo vispārējo tiesību principu juridiskais spēks, nozīmīgums ir uzskatāms par pielīdzināmu likumiem.
Pašvaldību saistošajiem noteikumiem ir tieša ietekme katras pilsētas, novada iedzīvotāju vidū, tādēļ svarīgi, ka tie veidoti, balstoties uz iedzīvotāju interesēm, tiesībām, brīvībām.
Jēkabpils pašvaldība, tāpat kā citas Latvijas pašvaldības, arvien vairāk pievērš uzmanību saistošo noteikumu atbilstībai citiem tiesību avotiem, uzsverot netieši to saistošajos noteikumos, taču rodas problēmas, kad šos noteikumus lieto praksē. Bieži vien iedzīvotāju un arī domes amatpersonu nekompetence noved pie uzskata, ka saistošie noteikumi ir pretrunā vispārējiem tiesību principiem, lai gan neatbilstība rodas ārējā lēmuma interpretācijā.
Jāpiebilst arīdzan, ka saistošie noteikumi izdoti un saturiski sastādīti, ievērojot normatīvos aktus, tai skaitā vispārējos principus, taču piemērošana vai nonākšana līdz saturiski korektiem saistošajiem noteikumiem, notiek pārkāpjot vispārējos tiesību principus. Municipal binding regulations has a direct effect of each city, county population, so it is important that they are formed on the basis of citizens' rights, freedoms.
Jekabpils municipality, like other Latvian government, has been paying increasing attention to the binding rules of conformity with other sources, highlighting indirectly to the binding regulations, but problems arise when these rules are used in practice. Often, residents and officials of the City Council was not competent to lead opinion that mandatory rules are contrary to general principles of law, although the discrepancy arising from the external interpretation of the decision.
It should be noted also that the binding regulations issued and substantively prepared in compliance with laws and regulations, including general principles, but application or to get to the content correctly regulatory provisions, is contrary to general principles of law.
