"Ne bis in idem" principa piemērošanas aktuālie jautājumi nodokļu tiesību lietās.

Bakalaura darba pētījuma mērķis ir izprast ne bis in idem (divkāršās sodīšanas aizlieguma) principa saturu un šī principa piemērošanu nodokļu tiesībās. Mērķa sasniegšanai autors analizē Latvijas tiesību sistēmā paredzētos par nodokļu pārkāpumiem piemērojamos sodus, apskatot un izvērtējot ne bis in idem principa piemērošanas praksi tiesās, identificējot divkāršās sodīšanas riskus un sniedzot priekšlikumus to novēršanai.
Autors secina, ka Latvijā par nodokļu pārkāpumiem sodus var piemērot trīs dažādu procesu rezultātā: kriminālprocess, administratīvo pārkāpumu process un nodokļu audits. Tā kā normatīvais regulējums starp šiem procesiem nodokļu tiesību ietvaros nav pilnībā saskaņots, autoraprāt pastāv risks sodiem pārklāties. Tādēļ darba noslēgumā autors piedāvā veikt normatīvā regulējuma harmonizāciju, ņemot vērā ne bis in idem principu. The aim of the bachelor’s research paper is to comprehend the essence of the principle ne bis in idem (prohibition of twofold penalization) and the application of this principle in the tax law cases. In order to achieve this aim the author analyses the applicable penalties provided by the legal system of the Republic of Latvia in the cases of tax fraud, reviews and evaluates the application of the ne bis in idem principle by the courts, identifies the risks of twofold penalization and provides suggestions to avert them.
The author concludes that there are 3 procedures in the Republic of Latvia by which the penalties for the tax fraud can be applied: the Criminal Procedure, Procedure of the Administrative Violations and the Tax Audit. Taking in account that there is not a complete harmonization between these procedures regarding the tax law application author concludes that there might be risks of penalties being overlapping. Thus in the final part the author proposes to make the harmonization of the regulations by applying the ne bis in idem principle.
