Kreditoru sūdzības Maksātnespējas procesa ietvaros

Bakalaura darba ietvaros, galvenokārt, ir izpētītas sūdzības, kuras ir tiesīgi iesniegt kreditori, ja viņu tiesības maksātnespējas procesā ir aizskartas. Maksātnespējas tiesiskajā regulējumā pastāv vairāki veidi, kā kreditori var aizstāvēt savas intereses. Līdz ar to, šī darba mērķis ir izpētīt kreditoru tiesības maksātnespējas un tiesiskās aizsardzības procesu ietvaros, kā arī kreditoru iespējas iesniegt sūdzības, kā šo tiesību neatņemamo daļu.
Lai sasniegtu šo mērķi, darbā ir aplūkoti gan viss maksātnespējas procesa regulējums, gan vairāki Maksātnespējas administrācijas un tiesas pieņemtie lēmumi sakarā ar kreditoru sūdzību izskatīšanu. Ir izanalizētas visbiežāk iesniegto sūdzību kategorijas, izvērtēts normatīvais regulējums attiecībā uz sūdzību iesniegšanas un izskatīšanas kārtību. Ir izvērtēti praktiskie trūkumi maksātnespējas tiesiskajā regulējumā, kurus novēršot, pēc autores domām, varētu samazināt iesniegto sūdzību skaitu, panākt kreditoru, kā kreditoru kopumā, tā arī katra atsevišķa kreditora, tiesību efektīvāku aizsargāšanu. Kā šobrīd spēkā esošā tiesiskā regulējuma uzlabojums, darbā ir piedāvāts, piemēram, noteikt administratoru atlīdzības maksimālo ierobežojumu, izskatīta iespēja paredzēt tiesas pieņemto lēmumu pārsūdzēšanu augstākstāvošajā instancē. Darbā arī ir izteiktas domas attiecībā uz administratora interešu konflikta problēmu, kas ir viena no izplatītajām sūdzību iesniegšanas iemesliem, un ir izteikti ierosinājumi minētas problēmas novēršanai. In the Bachelor’s paper, there are investigated complaints eligible by the creditors to be submitted if their rights have been violated in the insolvency proceedings. In the insolvency legislation there are several ways how creditors can assert their interests. Consequently, this work is aimed to explore the rights of creditors within the insolvency and legal protection proceedings and the creditors’ opportunities to lodge complaints as an inalienable part of these rights.
To achieve this aim, the research deals with a number of decisions taken by the Insolvency administration and the court with regard to creditors' claims. There are analyzed the most common complaints submitted, there is examined the regulative framework for complaint application and reviewing procedures. The possible weaknesses in the regulative framework of insolvency are assessed and by preventing them, according to the author’s view, the number of the submitted complaints could be reduced, there could be achieved a more effective protection of the rights of creditors- both creditors as a whole and each individual creditor. As the current regulative framework improvement, for instance, in the research there is proposed to establish an upper limit of the administrators’ remuneration, an opportunity to have the possibility of the judicial appeal against decisions in the superior instance. In the research there has also been expressed an opinion with regard to the issue of the administrator's interest conflict which is one of the most widespread reasons for the submission of complaints and it is proposed how to troubleshoot the above issues.
