After the ruling by Consitutional court a gap has been left in the Latvian legislation by
void articles on the amount of capacity of a person, which for now has been filled by a
temporary regulation. Adoption of new amendments is not easy, because, before the adoption
of new regulations which will take the place of the outdated law, there must be careful
evaluation of all the problems that might arise from the implementation of supported decision
making and partial capacity institute. It is important to know what criteria the court will be
guided by when determining the areas in which that person can’t make desicions for oneself,
how the new amendments will affect other laws and if the new regulation will fit international
requirements.
