Tiesības uz nekustamo īpašumu un to ierobežojumu iespējamība Satversmē

Abstract

Autores Bakalaura darba tēma ir „Tiesības uz nekustamo īpašumu un to ierobežojumu iespējamība Satversmē”. Darbs atspoguļo tiesību uz nekustamo īpašumu saturu, šo tiesību vēsturisko apskatu, kā arī to regulējumu gan Latvijas, gan starptautiskajos tiesību aktos. Darba otrā nodaļa ir koncentrēta uz cilvēka pamattiesību uz nekustamo īpašumu ierobežojumu iespējamību pētīšanu un analizēšanu Satversmes kontekstā. Analizējot Satversmes tiesas praksi, autore savā darbā piedāvā arī konkrētu priekšlikumu redakcionāli mainīt Satversmes 105.panta regulējumu. Autore ir pētījusi un analizējusi tādu valstu kā Amerikas Savienoto valstu, Francijas, Vācijas un Ķīnas Tautas Republikas normatīvo regulējumu attiecībā uz tiesībām uz nekustamo īpašumu un to ierobežojumu iespējamību, kā arī tiesu prakses materiālus.

The bachelor paper “Right to own real estate and the possibility of its restrictions in Constitution” represents the content of the rights to a real estate, the historical overview of these rights, as well as their normative regulation both in Latvian law and in the international law. The second chapter is focused on studying and analyzing the constitutional context of the possibility to restrict the basic human rights to own real estate. Analyzing the judgments of the Constitutional Court of Latvia, the author in her work also represents a concrete proposal to editorially change the constitutional regulation of an Article one hundred and fifth. The author has studied and analyzed the normative regulation regarding the right to own real estate and the possibility to restrict them, in such countries as United States, France, Germany and the People's Republic of China, as well as the materials of case law.
