Šī darba apgalvojums ir „Vēršot piedziņu uz viena no kopīpašniekiem domājamo daļu, pārējie kopīpašnieki ir nepietiekami aizsargāti”. Tātad galvenais mērķis ir apstiprināt un pierādīt vai apgāzt šo apgalvojumu. Darba gaitā šis apgalvojums tika apstiprināts ar vispusīgu analīzi, un tika piedāvāti situācijas alternatīvi risinājumi.
Piespiedu izsoles rezultātā netiek noslēgts pirkuma līgums, bet šī ir lietu tiesība, kas ierakstāma zemesgrāmatā uz tiesas lēmuma pamata, ar ko apstiprināts izsoles akts. Tiesa apstiprina, ka īpašumtiesības uz nekustamo īpašumu pāriet jaunajam ieguvējam par noteiktas summas samaksu. Šāda veida pārdevumu nevar uzskatīt par līgumu, jo visi līgumi paredz abu pušu gribas izteikumus.
Kopīpašniekiem jāļauj iegādāties parādnieka domājamo daļu par tirgus vērtību. Šim procesam jābūt ātrākam nekā piespiedu izsoles rezultātam. Tādā gadījumā arī kreditors būs vairāk ieinteresēts, lai parādnieka domājamā daļa nokļūtu pie kopīpašniekiem. The statement of this work is "If debt recovery is applied to one of the co-owners undivided share, the other co-owners are not sufficiently protected." So the aim of the work is to confirm and prove or refute this claim. During the process of work the above claim were confirmed by a comprehensive analysis and possible alternative solutions were offered.
Forced sales auctions do not result in a real contract of sale, but this is a property right to be entered into the land register based on a court decision, which approved the act of the auction. This type of sales may not be regarded a contract, because all the contracts need both parties’ expressions of intent.
Regarding debt recovery applied to the real estate, for the rights of co-owners', creditors' and debtors' interests a more reasonable solution could be found. Co-owners must be allowed to acquire the debtor's undivided share for the market value. This process would be faster than the result of forced sales. In this case, the creditor will be more eager the co-owners to get the debtor's undivided share.
