Juridiskās ētikas pārkāpumi tiesnešu profesionālajā darbībā

Abstract

Tiesu vara ir viens no demokrātiskas valsts pamatprincipiem, un valstij ir pienākums nodrošināt personām tiesības uz neatkarīgu un taisnīgu tiesu. Bakalaura darbā „Juridiskās ētikas pārkāpumi tiesnešu profesionālajā darbībā” tiek pētītas tiesnešu ētikas un profesionālās darbības uzraugošās institūcijas Latvijā, sniegts ieskats tiesnešu uzraudzības organizācijās Eiropas un pasaules līmenī, kā arī salīdzināti Latvijas tiesnešu ētiku regulējošie akti ar ārzemju normatīvajiem aktiem. Tiek analizēti tiesnešu ētikas smagākie pārkāpumi praksē, kā arī aplūkoti procesi, kurus aizsāka skandalozi un plaši medijos pārrunāti notikumi, kas sasaistāmi ar būtiskiem ētikas pārkāpumiem. Autore sniedz priekšlikumus, kas būtu darāms, lai turpmāk izvairītos no smagiem tiesnešu pārkāpumiem, kas būtiski ietekmē tiesas spriešanas un objektīva, tiesiska un taisnīga lēmuma pieņemšanu.

Judicial power is one of the main principles of a democratic state, and the state has an obligation to provide individuals the right to an independent and fair trial. In the Bachelor’s thesis „Violations of legal ethics in the professional activity of the judiciary” judicial ethics in Latvia and the supervising institutions of the judiciary are studied, an insight into the judges' supervisory bodies in European and international level is provided, and the laws and regulations of the legal ethics are compared to foreign ethics regulations. The most serious violations of legal ethics are analysed, and the processes that were initiated by scandalous and widely discussed events, that were connected to serious violations of the ethics of judiciary. The author provides suggestions that can be done to avoid further serious violations of the ethics of judiciary that substantially affect the process of a fair trial and the objective, fair and legal decision-making.
