| dc.description.abstract | Kriminālprocesa likuma 26. nodaļa, tieši, morālā kaitējuma kompensācija nereti sagādā problēmas tiesību piemērotajiem un cietušajiem to izprast. Dažas lietas ir noregulētas tikai ar judikatūras palīdzību, bet likumā nav noteiktas, kas rada problēmas.
Bakalaura darba mērķis ir noskaidrot, kādi apstākļi jāņem vērā tiesai, nosakot morālā kaitējuma kompensācijas apmēru, kas ir tiesīgi saņemt morālā kaitējuma kompensāciju un kuriem ir pienākums to atlīdzināt. Kā uzdevumi ir izvirzīti – sniegt iespējamos priekšlikumus morālā kaitējuma institūta uzlabošanai, lai atvieglotos tā piemērošana praksē.
Analīzes rezultātā tiek sniegti vairāki priekšlikumi Kriminālprocesa likuma normu pilnveidei, kā arī rasti jauni aspekti saistībā ar kompensācijas apmēra noteikšanas metodēm. | en_US |
| dc.description.abstract | Chapter 26th (compensation for moral damages) of Criminal Procedure Code of the Republic of Latvia is often causing problems to courts and victims to comprehend it. For instance, some things are regulated only with judicature, but are not specified in Criminal Procedure Code.
The goal of Bachelor thesis is to find out what circumstances court has to take into consideration when determining the amount of compensation for moral damages, what persons are eligible to receive and who are required to compensate them. The tasks are – to offer possible ways to improve the institute of moral damages, so that its application would be proper.
As a result of analysis, there are given several propositions how to improve legal provisions of Criminal Procedural Code and found new aspects related to methods how to determine the amount of compensation. | en_US |
