Ierobežotas rīcībspējas ieviešana Latvijas likumdošanā ir paredzēta ieviešot izstrādātos grozījumus, lai pilnīgas rīcībnespējas institūtu aizstātu ar ierobežotas rīcībspējas institūtu. Bakalaura darbs aptver ierobežotas rīcībspējas institūta ieviešanu Latvijā, tā tiesisko aspektu izpēti kopsakarā ar Latvijas likumdošanu, saistošiem starptautiskiem līgumiem un tiesu praksi. Darba galvenais mērķis ir ierobežotas rīcībspējas institūta ieviešanas Latvijā analīze, lai noteiktu iespējamās pastāvošās problēmas un pretrunas ar citiem normatīviem aktiem, kā arī tiesību ierobežojumus un priekšlikumus to novēršanai. Lai noteiktu iespējamās problēmas un to risinājumus rīcībspējas institūta regulējumā, salīdzinoši liela loma tiek atvēlēta personu tiesību ierobežošanas analīzei.
Izvirzītā mērķa sasniegšanai sākotnēji tiek skatīts tiesību regulējums, kas pastāvēja līdz 2012.gada 1.janvārim, lai noteiktu cik lielā mērā tika ierobežotas personas tiesības atzīstot personu par rīcībnespējīgu. Šo uzdevumu analīze balstās uz Satversmē nostiprinātajām Cilvēktiesībām, Vispārējo cilvēktiesību deklarāciju, ANO Konvencija „Par personu ar invaliditātes tiesībām”, kā arī uz starptautisko tiesu praksi un Latvijas tiesisko rīcībspējas regulējumu. Tiek analizēts pagaidu rīcībspējas regulējums, līdz Civillikuma grozījumu pieņemšanai. Salīdzinoši liela uzmanība tiek veltīta jaunajam rīcībspējas regulējumam un personām ar ierobežotu rīcībspēju tiesiskajai aizsardzībai.

The thesis focuses on the limited legal capacity institutions introduction in Latvia, the research of its legal aspects in connection wtih Latvian legislation, binding international treaties and case law. The core objectives of the thesis include the study of process in legal capacity institutions suggested in Latvia in order to discover the current and potential issues facing it and contradictions within other normative acts; as well as to find legal restrictions and mean to avoid the issues. In order to find the potential issues and alterations for them in legal capacity institutions a relatively large part is allocated for the analysis of the limitations on human rights.
To achieve the thesis’initial objectivean analysis of the legal regulations existing till January 1st, 2012 must be completed, which would allow us to see from the full extent were the human rights limited when a person was accepted as being incapacitated. It was analysed based on the Constitution of the Republic of Latvia, the Universal Declaration of Human Rights, the UN Convention of the Rights of Personswith Disabillities as well as on the international case law and the Latvian legal capacity’sregulations. The temporary legal capacity regulations. The temporarylegal capacity regulations, too, have been analysed till the Civil Law amendment adoption. Comparatively large amounts off attention have been drawn to the nwe legal capacity’s regulations and to persons with limited capacitated legal defense.
