Autortiesību civiltiesiskā aizsardzība Latvijā

Abstract

Bakalaura tēma ir „autortiesību civiltiesiskā aizsardzība Latvijā”, kurā ir analizēta autortiesību civiltiesiskās aizsardzības būtība un nepieciešamība, autortiesību aizsardzība pirms pārkāpuma un autortiesību aizsardzība pēc pārkāpuma. Šī tēma ir izvēlēta, jo autortiesībām ir nozīme sabiedrības progresā, ekonomiskajā attīstībā. Kaut arī izvēles iespējas kā aizsargāt autora darbus pastāv, tomēr šādu darbu aizsardzība nav efektīva un pilnīga. Darba mērķis ir noskaidrot iespējamos aizsardzības veidus, to būtība un nepieciešamību, autora vai autora mantisko tiesību īpašnieka tiesības rīkoties ar darbu, lai maksimāli nodrošinātos pret iespējamajiem pārkāpumiem, kā arī izpētīt kādas ir iespējas, kuras autors vai autora mantisko tiesību īpašnieks var izmantot autortiesību pārkāpuma gadījumā. Darbā tiek analizētas autortiesību aizsardzības iespējas, tiek sniegti secinājumi un iespējamie risinājumi. -

The theme of the Bachelor paper is „Copyright Protection in Civil Law in Latvia”. The present paper is devoted to the analysis of the copyright protection in civil law and its necessity in order to prove the significance of copyright in the progress of society and development of economy. Although there are some definite opportunities how to make all rights reserved, still the protection of those works is not effective enough. The goal of the present paper is to collect and analyse the available literature on possible types of copyright protection, to clarify an author’s or an owner’s of author’s economic rights rights to maintain with his/her work in order to assure him/herself of possible infringement. The author of the Bachelor paper investigates all the possible opportunities an author or an owner of author’s economic rights can take advantage of in case of copyright infringement. The conclusions drawn and possible solutions given are based on the theory and analysis of the opportunities of copyright protection. -
