Saistību bezstrīdus piespiedu izpildīšanas institūts

Abstract

Bakalaura darba tēmu autore ir izvēlējusies „Saistību bezstrīdus piespiedu izpildīšanas institūts”. Saistību izpildīšana tiesas ceļā bezstrīdus piespiedu kārtībā ir instruments, ar kuru kreditoram īstā termiņā ir iespējams atgūt savu naudu, gadījumā, ja parādnieks nespēj pildīt savas saistības pienācīgā kārtībā. Bakalaura darbs sastāv no četrām nodaļām, no kurām viena sadalīta vairākās apakšnodaļās. Darba mērķis ir sniegt ieskatu par bezstrīdus procesa tiesisko statusu Latvijas Republikā un ar to saistītajā problemātikā, kā arī izpētīt reālo situāciju, kāda ir izveidojusies tiesu praksē, skatot minētās kategorijas civillietas. Darbs pārsvarā ir balstīts uz šobrīd spēkā esošo Civilprocesa likumu, kā arī dažādiem risinājumiem Latvijas Republikas tiesu praksē. Autore piedāvā iespēju likumdošanā iestrādātās teorētiskās nostādnes salīdzināt ar likumdošanas aktu tulkošanu un izmantošanu tiesu praksē, sniedzot savu vērtējumu par grozījumu izdarīšanu likumdošanā.

Topic of the thesis for the Bachelor’s degree chosen by the author is „Institute of unquestionable enforcement of commitments”. Unquestionable enforcement of commitments through judicial procedure is an instrument by which the creditor can within a short period of time recover his money, if the debtor fails to meet his obligations properly. The thesis for the Bachelor’s degree consists of four chapters, one of which is divided into a few parts. Objective of the thesis is to give an overview of legal status of the unquestionable enforcement in the Republic of Latvia and the related problems, as well as to investigate the actual situation applied in the judicial practice considering the civil cases of the said category. This thesis, in general, is based on the effective Civil Procedure Law as well as on different solution options in the judicial practice of the Republic of Latvia. The author offers the possibility to compare the theoretical approaches transposed to the legislation with interpretation of the laws and their use in the legal practice providing own assessment of amendments to the legislation.
