Seksuālo attiecību ar nepilngadīgajiem krimināltiesiskie aspekti

Abstract

Bakalaura darbā „Seksuālo attiecību ar nepilngadīgajiem krimināltiesiskie aspekti” autors izvērtē vairākas ar darba tematu saistītas problēmas – piekrišanas vecuma noteikšanu, atšķirības piekrišanas vecumā starp heteroseksuālām un homoseksuālām attiecībām un īpašos gadījumus, kad vispārējie nosacījumi par piekrišanas vecumu nav piemērojami. Autors arī analizē piekrišanas vecuma vēsturisko attīstību Latvijā un ārvalstīs, kā arī pašreizējo normatīvo regulējumu. Īpaša uzmanība ir pievērsta labprātīgām seksuālām attiecībām ar nepilngadīgajiem. Nelabprātīgas seksuālās attiecības ar nepilngadīgajiem analizētas tiktāl, cik tas ir nepieciešams, lai analizētu labprātīgās seksuālās attiecības. Bakalaura darba mērķis ir izpētīt Latvijas un ārvalstu krimināltiesisko regulējumu un praksi attiecībā uz seksuālajām attiecībām ar nepilngadīgajiem. Bakalaura darbā ir izmantota zinātniskā literatūra, publikācijas, normatīvie akti un tiesu nolēmumi latviešu, angļu un krievu valodā.

In the bachelor’s paper “Criminal law aspects of the sexual relations with minors” the author considers various problems relating this subject – determination of the age of consent, differences in relation to the age of consent between heterosexual and homosexual relations and special cases, where the general age of consent regulations could not be applied. Author also analyzes the historical development of the age of consent in Latvia and foreign countries, as well current legal regulations. Special attention is devoted to consensual sexual relations with minors. Non-consensual sexual relations with minors are analyzed so far it is necessary to analyze consensual sexual relations. The target of the bachelor’s paper is to research the criminal law regulations and practice in Latvia and foreign countries in relation to sexual relations with minors. In the bachelor’s paper scientific literature, publications, normative acts and judgments in Latvian, English and Russian were used.
