Ziemeļatlantijas līguma organizācijas dalībvalstu līguma par to bruņoto spēku statusu IX panta piemērošanas nosacījumi Latvijā.

Abstract

Bakalaura darba temats ir Ziemeļatlantijas līguma organizācijas dalībvalstu līguma par to bruņoto spēku statusu IX panta piemērošanas nosacījumi Latvijā (turpmāk – NATO Līgums par spēku statusu), kas regulē valsts atbildību attiecībā uz sabiedroto bruņoto spēku uzņemšanu, to ekonomisko nodrošinājumu un loģistikas atbalstu.

Darba autors izvirza hipotēzi, ka spēkā esošie saistītie Latvijas Republikas normatīvie akti praksē neatbilst NATO līguma par spēku statusu IX panta nosacījumiem. Atbilstoši šādai hipotēzei, autors darba ietvaros analizē problēmas, kādas pastāv saistībā ar NATO Līguma par spēku statusu IX panta piemērošanu Latvijā.

Darba mērķis ir sagatavot priekšlikumus par nepieciešamajiem grozījumiem Latvijas tiesību aktos, kuri regulē attiecības starp ārvalstu bruņotajiem spēkiem un Latviju kā uzņemošo valsti, šādi nodrošinot Latvijas tiesību aktu atbilstību NATO Līguma par spēku statusu burtam un garam.

Lai panāktu plānoto rezultātu, izmantota pašreizējā Latvijas pieredze, kā arī citu NATO dalībvalstu pieredze NATO Līguma par spēku statusu IX panta noteikumu piemērošanā. Darba ietvaros autors izskaidro galvenos NATO Līguma par spēku statusu darbības pamatprincipus, kā arī aplūko līguma vēsturisko veidošanas procesu. Darba galveno daļu sastāda Latvijas tiesību aktu analīze, kuri ir saistīti ar NATO Līguma par spēku statusu IX panta piemērošanu. Tiek analizētas tādas jomas kā nodokļu sistēma, preču un pakalpojumu nodrošinājums, valsts transporta sistēmas un satiksmes infrastruktūras nodrošināšana, darbaspēka nodrošinājums, būvju un zemes platību nodrošinājums, kā arī medicīniskā atbalsta sniegšana.

Darba autors aizstāv sākotnēji uzstādīto hipotēzi, pamatojoties uz praktisku pieredzi, kāda iegūta Latvijā organizējot dažādus liela mēroga pasākumus, piemēram, ASV un Baltijas militārās mācības Saber Strike 11, BALTOPS 2010 un NATO Rīgas Samitu 2006. gadā.

Darba noslēgumā autors izvirza priekšlikumus attiecībā uz nepieciešamajiem grozījumiem un uzlabojumiem nacionālā līmeņa normatīvajos aktos.

The bachelor thesis paper “The Conditions for Implementing the North Atlantic Treaty Organization Status of Forces Agreement Paragraph IX in Latvia (NATO SOFA)” is about the applicability of national legal norms regarding economic provisions and logistic support in the framework of NATO SOFA article IX.

The author presents the hypothesis that the NATO SOFA and national legislation are formally interoperable, but still face challenges when NATO SOFA article IX is being implemented in real-life.

The aim of the thesis paper is to develop proposals for the improvement of national laws and legal acts in order to meet NATO SOFA article IX requirements thus ensuring that national legislation is in line with the NATO SOFA’s spirit and letter.

In his thesis paper the author explains the basic principles of how the NATO SOFA works and touches upon the history of the preparation of the agreement. The body of the work is an analysis of the respective national laws and legal norms related to the implementation of the conditions of NATO SOFA article IX.

The main analysis pertains to the legal norms covering such areas as tax policy, exchange of goods and services, transportation and logistic support, employment of civilians and labor policy, as well as medical support to allied forces personnel.

In his analysis the author defends the validity of the previously stated hypothesis with real life examples drawn from the experience gained during events such as the US – Baltic military exercise Saber Strike 11, US and NATO PfP exercise BALTOPS 2010 and the NATO Riga Summit 2006.

The bachelor thesis paper concludes with proposals regarding the necessary changes and improvements in national laws and legal acts such as the laws regulating the Value Added Tax and Excise Tax, construction norms, medical support, protected territories and other issues.
