Tieslietu padomes loma tiesu neatkarības īstenošanā un attīstības iespējas.

Abstract

Bakalaura darbs veltīts Tieslietu padomes lomas tiesu neatkarības principa īstenošanā Latvijā noskaidrošanai un tās attīstības iespēju noteikšanai. Latvijas tiesu sistēmā jau pirms iestāšanās Eiropas Savienībā bija vērojama pārlieku liela sasaite ar izpildvaru, kura joprojām ir pārlieku liela. Darbā tiek pētīts veids, kā stiprināt tiesu neatkarību, izmantojot Tieslietu padomi izpildvaras funkciju mazināšanai, izslēdzot tieslietu ministra lieto ietekmi uz tiesu varu. Darbā tiek piedāvāts paplašināt Tieslietu padomes funkcijas, aptverot tiesnešu amata kandidātu izvirzīšanu un pārņemot tiesu budžeta pieprasījuma sastādīšanu, tādējādi samazinot izpildvaras ietekmi, ar Tieslietu padomes palīdzību, stiprinot tiesu neatkarību un noskaidrots, ka Tieslietu padome ir spējīga kļūt par reālu tiesu neatkarības garantu.

The topic of this thesis is Judicial Council's role in the implementation of the principle of judicial independence in Latvia and its development opportunities. Latvian court system already before joining the European Union was with an over-aggregation with the executive, which is still too high. Work is exploring ways to strengthen the independence of the judiciary through the Judicial Council and reducing the function of the executive over court system, reducing the power of the Minister of Justice used to influence the judiciary. Thesis proposes to extend the functions of the Judicial Council, including a judge nominations and taking over the judicial budget request, thereby reducing the impact of the executive, with the assistance of the Judicial Council, strengthening the independence of the courts and found that the Judicial Council is able to become a real guarantor of judicial independence.
