Nelikumīgo kombatantu statuss starptautiskajās tiesībās

Abstract

Darbā ir apskatīts nelikumīgo kombatantu statuss starptautiskajās tiesībās. Pētījuma mērķis ir vispusīga nelikumīgo kombatantu statusa izpēte, definējot nelikumīgos kombatantus, apskatot priviliģētos statusus starptautiska bruņota konflikta ietvaros un noskaidrojot, kā persona var pazaudēt savu priviliģēto statusu un kļūt par nelikumīgo kombatantu, tiek analizēti ar statusa zaudēšanu saistītie procesuālie jautājumi. Tiek apskatīta valstu prakse, ieskaitot nacionālos normatīvos aktus, kas regulē nelikumīgo kombatantu statusu. Iegūtās atziņas tiek piemērotas praktiski, apskatot iespējamos priviliģēta statusa zaudēšanas gadījumus un nosakot personas tiesības katrā no tā posmiem. Darba beigās autors sniedz ieteikumus tiesiskā regulējuma tālākai attīstīšanai un uzlabošanai. The paper analyses the status of unlawful combatants in the international law. The goal of the research is to provide comprehensive research of the status of the unlawful combatants, by defining the unlawful combatants, reviewing the privileged statuses in the context of international armed conflict and to clarifying how one can lose his privileged status and become an unlawful combatant, procedural aspects of losing ones privileged status are analyzed. State practice is examined, including national legal acts which define the status of unlawful combatants. Results of the analysis are used in practice to examine the possible ways of losing ones privileged status and define the rights of the person in each of the stages of such process. In the end author provides recommendations for the further development and improvement of the legal acts.
