Dienesta pilnvaru pārsniegšana

Abstract

Bakalaura darba galvenais mērķis ir izveidot visaptverošu pētījumu par dienesta pilnvaru pārsniegšanu. Problēmas pastāv tiesu praksē ar būtiska kaitējuma konstatēšanu un pamatošanu, kas ir noziedzīgā nodarījuma obligāta objektīvās puses pazīme. Darbā autore analizē tiesas spriedumos veikto būtiskā kaitējuma pamatojumu, kā arī tiesību zinātnieku atziņas šajā jautājumā. Turklāt vairākos likumos atšķirīgi tiek definēts valsts amatpersonas jēdziens, kas ir noziedzīgā nodarījuma speciālais subjekts, tāpēc tiks pētīts valsts amatpersonas jēdziens krimināltiesību izpratnē. Darbā tiek analizēti visi noziedzīgā nodarījuma sastāva elementi, vēršot uzmanību uz problēmām tiesu praksē. The aim of the bachelor is to create a comprehensive survey about exceeding official authority. Problems exist in case law with determination and motivation of serious damage which is a mandatory feature of the objective part in this criminal offense. Also there are a number of different laws defining the concept of public official, which is the special subject of criminal offence, therefore author will examine the concept of public official in criminal law. The author will analyze the court judgments on the ground of serious damage. Also will be examined the constituent elements of exceeding official authority, focusing on the problems that arise in case law.
